Book excerpt: The intent of the persons who prescribe and administer the medication seems to be the key in determining whether charges would be laid in these circumstances, that is, whether the medication was administered with the intent of killing the patient or to ease the patient's pain. [...] Referring to the current legal status of total sedation, the Special Senate Committee stated: If the sedation is done with the consent of the patient or the patient's surrogate, it is legal. [...] It expired with end of the 1st session of the 36th Parliament.21 In 1999, Senator Carstairs introduced another bill, again designed to clarify the law with respect to pain control and sedation practices.22 It expired on the order bill when a new federal election was called at the end of the 2nd session of the 36th Parliament. [...] The third major question in this discussion of palliative care and the law is whether "mature-minors" (children who have not yet reached the age of majority but who understand the nature and consequences of the decision to be made) can consent to the provision of potentially life-shortening palliative treatment. [...] Provisions in the Civil Code of Quebec state that a minor over the age of 14 may consent alone to care not required by the state of his or her health, but consent of a parent or tutor is required if the care entails a serious risk to the health of the minor and may cause grave and permanent effects.24.
