Book excerpt: This book explores non-electoral means of public participation in contemporary China, both as an outcome of and a key contributor to the party-state’s efforts to improve its governing capacity. Examining consultative meetings, public hearings, and the use of surveys and questionnaires in Zhejiang province, on an empirical level, the study evaluates the historical development and institutional backgrounds of these mechanisms, as well as provides a critical assessment of their achievements and failures. At the same time, on a theoretical level, this book contributes to the broader scholarship on contemporary Chinese politics and political development within one-party regimes, as well as debates about state building and democratisation. Relying on the distinction between access to and exercise of power, it concludes that non-electoral public participation is in fact a function of state building. Developing a state capable of producing effective solutions to governing challenges, it is argued, requires public participation in the governing process. With analysis informed by interviews with local-level policy-makers and officials, academics, and citizens’ representatives and activists, Public Participation and State Building in China will be a valuable research resource for students and scholars of Chinese politics, political science, and civil society.

Abstract: Public participation, as a form of direct democracy, is becoming increasingly popular in the government policy-making process in China. This thesis argues that public participation in China acts neither as a supplement to a well-founded democratic system, nor as an alternative to an electoral democracy, nor even as an effective accountability politico-legal institution. Instead, contemporary public participation is an interim measure that caters to an urgent social need and provides temporary legitimacy to the state. As such, it is the first step towards further political liberalization, for which it lays a foundation. The public participation system in China has developed from its original form as a solely state-led, political campaign-oriented system in the closed era to the coexistence of three ideal-type public participation in the open era: state-led, issue-specific participation, spontaneous, issue-specific, group-based participation and spontaneous, issue-specific, individual-based participation. Public hearing, corporate lobbying and e-participation can be correspondingly treated as representative mechanisms of the three ideal-type public participation in China. In addition, the institutions of open government information and judicial redress are currently the most significant support structures for this system. Relying on the methodologies of case studies, statutory interpretation, quantitative calculation and socio-legal analysis, the thesis finds that citizens can articulate their demands on policies in public hearings, but government organs are inclined to prevent any substantial challenge to their proposed policies. Although business groups have not been conferred with any special systematic opportunity to participate in the formulation of policy, corporate lobbying contributes towards undermining the government''s monopoly in the policy-making. Citizens in e-participation take full advantage of the flexibility and anonymity of the Internet to enjoy a free, low-risk space of debating government policies and monitoring government officials. Although the implementation of the Regulations on Open Government Information has been basically satisfactory, the Regulations have failed to establish the necessary transparency for public participation. What citizens seek in public participation litigations is not only judicial redress of their grievances, but, even more significantly, de facto influence on a policy-making process taking place outside the courtrooms. The public participation system as a whole in China has a paradoxical character in contextual, structural, functional and developmental aspects. Its essential defect is to fall short of a device that makes government policymakers accountable for the output of public participation. The public participation system is used by the state as a viable trajectory for its own legitimization to secure the formal validation of government policies and to reduce the risks that it confronts in the ongoing democratization process. It is used by citizens as a locus of their self-expression values and as an incubator of their developing citizenship, also providing a prompt channel for citizens'' rightful contest. This book proposes that the state we see today has developed over the past two centuries largely as a response to internal challenges emerging from the late empire. Well before the Opium War, Chinese confronted such constitutional questions as: How does the scope of political participation affect state power? How is the state to secure a share of societys wealth? In response to the changing demands of the age, this agenda has been expressed in changing language. Yet, because the underlying pattern remains recognizable, the modernization of the state in response to foreign aggression can be studied in longer perspective. The author offers three concrete studies to illustrate the constitutional agenda in action: how the early nineteenth-century scholar-activist Wei Yuan confronted the relation between broadened political participation and authoritarian state power; how the reformist proposals of the influential scholar Feng Guifen were received by mainstream bureaucrats during the 1898 reform movement; and how fiscal problems of the late empire formed a backdrop to agricultural collectivization in the 1950s. In each case, the author presents the "modern constitutional solution as only the most recent answer to old Chinese questions. The book concludes by describing the transformation of the constitutional agenda over the course of the modern period.

These systemic changes soon led to social and political developments while the party-state regime remained still. Today's China does not have formal mechanisms of political representation such as elections. However, the rapid changes in the economic and social environment have produced new and mostly informal ways of political participation, such as protests, petitioning, and online public campaigns. Facing a more assertive society, the state responded to the need for political participation and representation with a project of 'administrative democracy'. This new government project mostly involves different mechanisms that enable citizens to participate in policy making.Citizen participation in public administration has become part of the official reform agenda in China since early 2000s. The administrative and legislative public hearings practiced in China are among the earlier examples of such institutionalized public participation. The existing literature on public hearings mostly focuses on the efficiency of the public hearings as a policy tool and their impact on policy-making. My research focuses on the effect of these institutions on the public perceptions about the state and public perceptions about citizens as political actors.I analyze the participant selection mechanism of public hearings, participant demographics and the relationship of the participants with the officials and the broader public in Guiyang, Wuhan and Qingdao. Qualitative data from these three cities, which are located in different socio-economic development zones, suggests that (1) both participants and the broader public see public hearings as a venue for political representation rather than a mere policy-making mechanism, and (2) participants use different strategies to achieve their goals in public hearings and create awareness in the broader public.My research methods are semi-structured interviews with public hearing participants, expert interviews with scholars and officials who designed the hearings in China and an analysis of the written and online media coverage of the public hearings.
