We begin, therefore, with the attempt to place upon the Parade - Ground, in 1869, the building for the great Musical Festival of that year. As will be seen by the record, permission was granted to erect a building there. The popular feeling Was so strong, however, that the managers Of that enterprise deemed it injudicious to accept the grant, and the building was placed upon land farther south and west. It is a fact, also, that at the time a committee of citizens had decided to appeal to the Supreme Judicial Court, if any attempt to build was made, and that eminent counsel were of Opinion, that the City Council had exceeded its legal powers in making the grant. The fact that applied elec tricity was unknown when these principles were first asserted does not prevent their extension and adaptation thereto, nor are such doctrines really changed thereby. Electric law is new, therefore, only in the sense that the uses of electricity have necessitated a new application in a different form, perhaps, of a very great number of those doctrines upon which is based the great body of existing laws. Recourse must, therefore, be had to these laws and principles, found chiefly in authoritative de cisions and treatises, in order to deduce any governing rule ap plicable to the various circumstances peculiar to electric causes requiring judicial determination. This has involved much re search, both by counsel and the judges, and much critical com parison and discussion resulting in some conflict of opinions. To examine each case, discover the underlying principle or principles, and endeavor to systematically arrange and group together the numerous points, so as to make a logical, exhaustive and still concise work, has been an arduous and difficult under taking. In addition, it has been necessary, not only to con scientiously examine legal decisions covering electricity, but a thorough investigation of the authorities in analogous cases has been required, in order to present fully the law applicable to the numerous and varying circumstances under which the courts have been called upon to apply old principles or to extend their application to this constantly growing branch of the law. The efforts of the authors in writing this treatise will, it is hoped, ao complish the purpose intended, and that is, to clearly, under standingly' and logically present to the profession the entire law on the subject of electricity, with the reasons for its application. Y., September 4, 1917 One Objection to governmental interference with the personal habits, or even the vices, of the individual is that it tends to weaken the effect Of the self-convincing moral standards and to put in their place fallible and changing conventions as the test of right conduct, with the consequent loss of the strengthening value to the individual Of the free exercise of his rational choice Of good rather than evil. Enforced discipline can never have the moral value of self-discipline, since it lacks the element of coo crating effort on the part of the individual, which is the very sou of all personal advancement. We may, therefore, well pause to consider whether the benefits which will result to society from a given interference of this character are sufficiently important to compensate for the loss of that fine sense Of personal inde endence which more than any other quality has enabled the Ang o-saxon race to throw Off the yoke of monarchical absolutism and substitute democratic self-government. It must not be forgotten that democracy is after all but a form Of government whose justification must be established in the same way that the justification Of any other form of government is established; namely, by what it does rather than by what it claims to be. The errors of a democracy and the errors of an autocracy will be followed by Similar consequences. A foolish law does not become a wise law Simply be cause it is ap roved by a great many people. The successful enforce ment of the aw in a democracy must always rest primarily in the fact that on the whole it commends itself to a universal sense Of justice, shared even by those who violate it. Any attempt, therefore, to curtail the liberties Of the citizen which shocks the sense of personal independence Of any considerable proportion of the community is likely to do more harm than good, not only because a strong feeling that a particular law is unjust lessens in some degree the reverence for. Law generally, but because such a law can not be successfully enforced, and a law that inspires neither respect for its justice nor fear for its enforcement is about as utterly contempt ible a thing as can be imagined.
