Available in PDF, EPUB and Kindle. Book excerpt: The scope of arrangements which provide for some degree of "autonomy" is almost unlimited, as are the norms and means which have been adopted to protect minority rights. Documents on Autonomy and Minority Rights offer examples of some of the unique structures which have been developed to respond to geographic, political, ethnic, linguistic, and other differences under a single sovereignty. They present a broad spectrum of domestic constitutional provisions, statutes, and political agreements, as well as a comprehensive collection of relevant international instruments. The first section includes documents adopted on a global or regional basis to set standards for the protection of minority rights and the rights of indigenous peoples. The second section includes a wide range of national documents related to minority rights and/or autonomy. The last section contains historical documents. The author has written a brief introduction to each document to give the reader unfamiliar with the situation to which a document pertains enough information to consider its context. No single text can be used as a model of autonomy, for every situation is unique. At the same time, however, greater knowledge of a broad range of successful and unsuccessful arrangements may inspire new ideas with which to address conflicts which have claimed tens of thousands of lives in recent years. At the very least, the ingenuity evidenced in some of the documents should encourage experimentation and underscore the need of going beyond the mere recitation of definitions of federalism, consociation, devolution, or other constitutional models. The great variety of institutional arrangements, the detailed provisions developed to resolve particularly difficult local problems, and the flexibility in addressing issues such as revenue-sharing or participation in international organizations, demonstrate that neither "sovereignty" nor "self-determination" need stand in the way of innovative solutions.

Book excerpt: Essential Readings in Canadian Constitutional Politics introduces students, scholars, and practitioners to classic authors and writings on the principles of the Canadian Constitution as well as to select contemporary material. To complement rather than duplicate the state of the field, it deals with the Canadian Charter of Rights and Freedoms and with Canadian mega-constitutional politics in passing only, focusing instead on institutions, federalism, intergovernmental relations, bilingualism and binationalism, the judiciary, minority rights, and constitutional renewal. Many of the selections reverberate well beyond Canada's borders, making this volume an unrivalled resource for anyone interested in constitutional governance and democratic politics in diverse societies.

Volume 3 has been newly written for this edition of the History, and covers the years from about 1960 to 1974. The contributors to this volume are Claude Bissell, Desmond Pacey, Lauriat Lane, jr, Michael S. Cross, Thomas A. Goudge, John Webster Grant, John H. Chapman, William E. Swinton, Henry B. Mayo, Malcolm Ross, Brandon Conron, Clara Thomas, Sheila A. Egoff, John Ripley, William H. New, George Woodcock, and Northrop Frye.

He examines the German context as closely as developments in Canada, offering a new, more complete approach to German-Canadian immigration.

Available in PDF, EPUB and Kindle. Book excerpt: Disputes over language policy are a persistent feature of the political life of many states around the world. Multilingual countries in the West such as Belgium, Spain, Switzerland and Canada have long histories of conflict over language rights. In many countries in Eastern Europe and the Third World, efforts to construct common institutions and a shared identity have been severely complicated by linguistic diversity. Indigenous languages around the world are in danger of disappearing. Even in the United States, where English is widely accepted as the language of public life, the linguistic rights of Spanish-speakers are hotly-contested. Not surprisingly, therefore, political theorists have started to examine questions of language policy, and how they relate to broader issues of democracy, justice and rights. This volume provides the reader with an up-to-date overview of the emerging debates over the role of language rights and linguistic diversity within political theory. It brings together many of the leading political theorists who work in the field, together with some of the most important social scientists, with the aim of exploring how political theorists can conceptualize issues of language rights and contribute to public debates on language policy. Questions of language policy are not only of enormous political importance in many countries, but also help to illuminate some of the most important debates in contemporary political theory, including questions of citizenship, deliberative democracy, nationalism, multiculturalism, identity politics, group rights, the liberal-communitarian debate, and so on. The thirteen essays in this volume highlight both the empirical constraints and normative complexities of language policy, and identify the important challenges and opportunities that linguistic diversity raises for contemporary political theory.

However, neither the British model of a "single sovereign" nor the American people's "sacred fire of liberty" matched the pluralistic identity of Canada, so Canadians engaged in constitutional experimentation. In Canada and the Ethics of Constitutionalism Samuel LaSelva argues that, in order to understand the old Canada of Confederation and the new one that followed the Charter of Rights and Freedoms, it is necessary to see how distinctive Canadian constitutionalism is and how that distinctiveness does not depend on borrowings from the British or American constitutional models. LaSelva supports his argument by exploring different aspects of Canada's contribution to the ethics of constitutionalism including the limits of free expression, the Charter's notwithstanding clause, the origins and functions of judicial review, the Quebec secession debate, Aboriginal self-government, and the conception of Canada as a multicultural and multinational mosaic. Through a careful consideration of how Canadian constitutional pluralism with its focus on the rights of others differs from American and British ideas, Canada and the Ethics of Constitutionalism provides engaging answers to contested questions about how Canada was founded and what it has become.

Available in PDF, EPUB and Kindle. Book excerpt: Beginning with brief accounts of the origins of Confederation and the economic, social, and political characteristics of late nineteenth-century Canada, Stevenson recounts the major issues that occupied the intergovernmental agenda. Liquor regulation in Ontario, land reform in Prince Edward Island, reluctant acceptance of Confederation in Nova Scotia, chronic financial problems in Quebec, controversy over Catholic schools in New Brunswick, and the roots of Western alienation in Manitoba and British Columbia are all described in detail. Stevenson then examines the process of intergovernmental relations and the significance of particular practices and institutions such as disallowance, reservation, federal-provincial conferences, and judicial review. In the final chapter he summarizes the evolution of Canadian federalism up to 1896 and briefly relates it to the current state of Canadian federalism. Based on extensive archival research, this book will interest political scientists, historians, and anyone curious to know the background of Canada's federal crisis.
