Book excerpt: La protection des mineurs non accompagnés est une problématique complexe qui se trouve à la croisée de différents régimes juridiques : droit international et européen des droits de l'homme et droit des réfugiés au niveau international ; droits de l'enfant et droit des étrangers au niveau national. En France, le droit protège ces mineurs contre l'éloignement, les exemptant ainsi d'obtenir un titre de séjour, et leur permet d'être pris en charge par les services de l'aide sociale à l'enfance, qui relèvent de la compétence du département. Cette protection reste néanmoins dépendante des enjeux politiques et juridiques gouvernant la gestion des flux migratoires par l'État. Ils ne devraient pourtant pas effacer l'impératif de respect des droits de l'enfant et de prise en considération de leur vulnérabilité. En effet, le droit des étrangers a bien plus influencé la façon dont le droit commun a été mis en œuvre au bénéfice des mineurs non accompagnés que l'inverse. Cela se traduit, d'une part, par la multiplication des instruments de faible valeur normative qui permettent d'adapter les règles selon l'objectif recherché par l'administration et, d'autre part, par la systématisation d'une phase d'accès des mineurs à leur prise en charge. Celle-ci se caractérise par une intervention croissante des services de l'État dans la procédure et surtout par une spécialisation du droit applicable. Enfin, la protection des mineurs non accompagnés est, à chaque étape, fragmentée et dépend des pratiques de tous les acteurs concernés. Cette protection est aujourd'hui particulièrement fragilisée et appelle, plus globalement, un renforcement des garanties conditionnant les droits de ces mineurs.
