Book excerpt: El derecho fundamental a la propia imagen, reconocido en el art. 18.1 de la Constitución Española y regulado en la LO 1/1982, de 5 de mayo, de Protección Civil del derecho al honor, a la intimidad personal y familiar y a la propia imagen, confiere a cada uno de nosotros la facultad de impedir, con carácter general, que otra persona capte, reproduzca o difunda por cualquier medio los rasgos físicos reconocibles que nos hacen distintos de los demás, principalmente, nuestro rostro. Si esto ocurre sin nuestro consentimiento, es muy probable que se haya cometido una intromisión ilegítima en nuestro derecho a la propia imagen. Sin embargo, no se trata de un derecho absoluto: la Ley prevé una serie de circunstancias que legitiman el uso de nuestra imagen por parte del tercero que se desenvuelva en la situación prevista por la norma; tercero que, de este modo, se habrá entrometido lícitamente, empleando la cobertura legal, en un ámbito que, de no concurrir dicha circunstancia legitimadora de la intromisión, quedaría reservado al titular de la imagen concernida. En esta obra se analiza el alcance que cabe atribuir a las circunstancias descritas en los arts. 2o y 8o de la citada Ley: el consentimiento del titular del derecho, la existencia de una previsión legal expresa o de un acto o mandato de la autoridad basado en la Ley, la concurrencia de ciertos intereses públicos, la captación de la imagen de las personas de notoriedad pública en actos o lugares abiertos al público o el uso de su caricatura y la aparición de la imagen de cualquier persona con carácter accesorio en la información gráfica acerca de algún acontecimiento de interés. El análisis teórico de la letra de la Ley aparece en la obra continuamente contrastado, apoyado o contradicho en sus resultados con un estudio exhaustivo de la aplicación práctica de estas circunstancias por parte de la jurisprudencia del Tribunal Constitucional y del Tribunal Supremo, que permite aquilatar cuál es el auténtico grado de efectividad de estos factores legales que posibilitan la existencia de intromisiones legítimas en el derecho a la propia imagen, principalmente, por parte de los distintos medios de comunicación social. A pesar de que haya quien piense que en las redes sociales vale todo, son muchos los tribunales que se han ido pronunciando condenando a los autores de estos mensajes tanto en el ámbito penal como en el civil. Esta monografía se centra en un análisis crítico sobre la responsabilidad civil cuando se produce la vulneración del derecho al honor en este ámbito. Se inicia la monografía con un estudio del derecho al honor así como su protección constitucional, para continuar con el análisis de los derechos a la libertad de información y expresión y sus límites. Especial atención a lo largo de todo el trabajo se presta a la responsabilidad civil que tendrá cada uno de los agentes que participan en la posible vulneración. Así se analiza la posible responsabilidad en la que pueden incurrir redes sociales como Twitter o Facebook y la de los propios usuarios, entre los que se incluyen los autores directos de los mensajes, aquellos que los comparten, los community manager y los que lo realizan de manera anónima. Igualmente se pretende establecer, de una manera lo más objetiva posible, cómo ha de realizarse la valoración del daño para el caso en el que se produzca la vulneración del derecho al honor. Por último, el libro trata también el sistema de reparación del daño para estos casos, en los que las resoluciones judiciales no están siguiendo una línea unitaria, realizando propuestas en base a los últimos medios disponibles.

A major gap still existing today relates to the experiences gathered in the national legal systems over the past decades. The present work attempts to fill this gap for one key element of tort law: the notion of damage. It thus does what the previous volume in the ‘Digest of European Tort Law’ series did for another key element, ie natural causation. Once again, the publication contains a selection of the most important cases decided in 26 states across Europe as well as by the European Court of Justice. For each case the facts and the relevant court decision are presented, and the decision is analysed within the wider context of the development of the respective legal system. In addition, the editors provide comparative analyses of the case law reported in this volume concerning all the specific problems raised under the heading of damage. The publication also looks into how key cases would be resolved under the European model rules drafted in the field of tort law; and it also highlights cases from earlier periods of legal history.
