Now, however, the rise in unemployment and lack of employment security, the dizzying inequality gulf, and the environmental disasters and mass migrations caused by this deregulation are generating an impetus that defines social justice no longer merely in terms of the equitable distribution of resources, but also – and often primarily – in terms of the just recognition of persons. This collection of incisive essays recognizes that the growing interdependence of all of the people of the earth demands that labour rights are understood as an aspect of human rights, and thus envisaged at the international level. Contributions by twenty outstanding labour law scholars from a range of countries worldwide provide in-depth analysis of such aspects of the debate as the following: – collective action in the interests of market effectiveness as well as fair outcomes for workers; - right to strike; - resilience of trade unions and collective bargaining as mechanisms of labour market regulation; - importance of national policy, despite the influence of global market forces, in shaping national outcomes; - work as the locus of the relationship between humans and nature; - search for a legal foundation for corporate social responsibility; - litigation as an alternative to collective bargaining; - the role of collective labour relations for immigrants and disabled people; - lessons that developed countries could learn from mechanisms pioneered in developing countries in coping with conditions of austerity; and - the trap of soft law and of declarations of intent that weigh lightly in the face of the power of the interests at play in international trade. The essays take stock of the dimensions of the current situation and also explore paths leading to a better achievement of social justice in labour law. These essays recognize that economic development and the pursuit of social justice are interwoven in a quest for social progress that includes mechanisms designed to eliminate unjustifiable inequality. For lawyers and other parties committed to the emerging political will to not only respect fundamental rights, but more broadly improve labour and environmental protection, this book opens abundant avenues that can be pursued in practice and in policy. The volume is based on a selection of papers presented at the 21st World Congress of the International Society for Labour and Social Security Law in Cape Town in 2015.

Book excerpt: After the 1960s, rapid urbanization in developing regions in Latin America, Africa, and Asia was marked by the expansion of low-income "irregular" settlements that developed informally and which, by the 2000s, often constituted between 20-60 percent of the built-up area of metropolitan areas and other large cities. There has been a variety of research directed at the housing policies involved with these informal settlements, yet apart from the activities of Latin American Housing Network (LAHN), there has been minimal attention directed at the earliest portion of settlements that formed some 25-40 years ago that now form a large part of the intermediate ring of the cities. This volume breaks new ground by opening up a new generation of housing policy in Latin America cities with broader application for other developing countries. Its editors bring unique perspectives: Peter Ward coordinates the LAHN, and Edith Jiménez and María Di Virgilio are founding members of the network who have led project teams in Guadalajara and Buenos Aires respectively. Developed as a coordinated collaborative research project, the volume encompasses nine Latin American countries and eleven cities. The editors and contributors offer original perspectives on the policy challenges facing much of the low income housing of Latin American cities; document the changing nature of the "first suburbs"; present comparative survey findings in order to better understand the types of consolidated settlements that exist today; describe the physical nature of the dwellings themselves; identify the reasons behind market dysfunction that impede the operation of consolidated housing informal markets in Latin American cities; and outline a new generation of housing policies that will support the processes of densification, rehabilitation, and regeneration of these settlements. This book is the first and only composite overview of the research findings and advocacy of the generic policy lines that the LAHN identifies as central to a new generation of housing strategies and approaches. Se trata de elecciones celebradas en once países cuyo estudio se desarrolla en igual número de capítulos. Se cubren comicios simultáneos a ambas instancias en Argentina, Bolivia, Brasil, Costa Rica, Guatemala, Panamá y Uruguay. En El Salvador y en Colombia, aunque se celebraron en tiempos distintos, ambos tipos de comicios se consideran en el mismo capítulo; allí, las presidenciales precedieron a las legislativas con un año de diferencia en el primer país y las legislativas antecedieron por tres meses a las presidenciales en el segundo. Se recogen también en capítulos independientes las elecciones únicamente legislativas de México y Venezuela. Si bien el criterio temporal siempre puede calificarse de caprichoso en este caso sigue la preocupación iniciada hace ocho años de dar cumplida cuenta del acontecer electoral en la región, en el ámbito de los dos poderes representativos del Estado por excelencia. En efecto, este volumen da continuidad a anteriores trabajos. El bienio aquí analizado da cabida a un nivel promedio de elecciones presidenciales, si se tiene en cuenta el acumulado en la región desde hace 30 años, por lo cual es representativo del quehacer político latinoamericano. Así, la Tabla 1 recoge las 117 elecciones presidenciales que se han llevado a cabo en la región entre 19861 y 2015 cuyo resultado no fue cuestionado; su media es de cuatro procesos electorales por año y aquí el número de elecciones que se recogen son nueve.
