Book excerpt: This brief begins with a review of the estimated numbers of gays in New Brunswick, the extent of anti-gay discrimination and hatred in the province as determined in a 1990 survey, and the legal protection of gay rights in Canada. The brief then makes recommendations for the proposed provincial Charter of Rights that would protect gay rights in New Brunswick. In support of those recommendations, the brief also reviews evidence such as opinion polls that favors support for gay rights. The appendix includes references to documents supporting gay rights, a summary of the anti-gay discrimination survey, and a 1992 update outlining recent cases under the Canadian Charter of Rights and Freedoms related to gay rights.

Available in PDF, EPUB and Kindle. Book excerpt: In Governing with the Charter, James Kelly clearly demonstrates that our current democratic deficit is not the result of the Supreme Court’s judicial activism. On the contrary, an activist framers’ intent surrounds the Charter, and the Supreme Court has simply, and appropriately, responded to this new constitutional environment. While the Supreme Court is admittedly a political actor, it is not the sole interpreter of the Charter, as the court, the cabinet, and bureaucracy all respond to the document, which has ensured the proper functioning of constitutional supremacy in Canada. Kelly analyzes the parliamentary hearings on the Charter and also draws from interviews with public servants, senators, and members of parliament actively involved in appraising legislation to ensure that it is consistent with the Charter. He concludes that the principal institutional outcome of the Charter has been a marginalization of Parliament and that this is due to the Prime Minister’s decision on how to govern with the Charter.

Available in PDF, EPUB and Kindle. Book excerpt: The constitutional notwithstanding clause set out in section 33 of the Canadian Charter of Rights and Freedoms (hereinafter referred to as the Charter of Rights or the Charter) has been controversial since its emergence from a November 1981 Federal-Provincial Conference of First Ministers. The controversy became more pronounced at the time of the 15 December 1988 Supreme Court of Canada decisions in the Ford and Devine cases dealing with the signage provisions of Quebec's Bill 101 (Charter of the French Language) and the subsequent adoption by the Quebec National Assembly of Bill 178 (An Act to Amend the Charter of the French Language). This legislation contained a section 33 override clause (in this case affecting Charter of Rights guarantees of freedom of expression (section 2(b)) and equality rights (section 15)). After setting out the content of the section 33 notwithstanding clause, this paper will trace its development in 1981 and describe the potential use then ascribed to it by its drafters, parliamentarians and others. The paper will then go on to point out actual instances when the notwithstanding clause has been invoked. Finally, it will present a number of arguments for and against the use of the clause.

Available in PDF, EPUB and Kindle. Book excerpt: The Canadian Charter of Rights and Freedoms may only be thirty-five years old but it is an important document for all Canadians. Few today, however, are aware of the extensive work and tumultuous debates that occurred behind the scenes. In The Charter Debates, Adam Dodek tells the story of the Special Joint Committee of the Senate and the House of Commons on the Constitution, whose members were instrumental in drafting the Charter. Dodek places the work of the Joint Committee against the backdrop of the decades-long process of patriation and takes the reader inside the committee room, giving them access to Cabinet discussions about constitutional reform. The volume offers a textual exploration of the edited proceedings concerning major Charter subjects such as fundamental freedoms, democratic rights, equality rights, language rights, and the limitations clause. Presenting key moments from the transcripts, carefully selected and contextualized, The Charter Debates is a one-of-a-kind resource for scholars, students, and general readers interested in the Charter and its impact on constitutional politics in Canada.

Available in PDF, EPUB and Kindle. Book excerpt: In Community Besieged Garth Stevenson describes the unusual circumstances that allowed English-speaking Quebecers to live in virtual isolation from their francophone neighbours for almost a century after Confederation. He describes their relations with Maurice Duplessis and the Union Nationale and their ambivalent response to the Quiet Revolution. New political issues - language policy, educational reform, sovereignty, and the constitution - undermined the old system of elite accommodation in Quebec, causing conflicts between anglophones and francophones and creating a new sense of anglophone identity that transcends religious differences. The changing relations of Quebec anglophones with the major political parties, as well as the role of newer entities such as Alliance Quebec and the Equality Party, are also examined. Stevenson concludes with a look at the future of anglophones in Quebec. Based in part on interviews with more than sixty English-speaking Quebecers who have played prominent parts in Quebec's political life, Community Besieged is a comprehensive and up-to-date description of the political life of this unique minority at both the federal and provincial level.

Book excerpt: Since 1967, the centennial of Confederation, numerous political crises, economic challenges, and international events have helped to transform Canadian society, and will continue to shape its future. Taking these various challenges and opportunities of the past into account, how does the future look for Canada? In Reflecting on Our Past and Embracing Our Future diplomats, politicians, scientists, and human rights leaders including Phil Fontaine, Michaëlle Jean, Ellen Gabriel, Paul Heinbecker, Bob Rae, Jean Charest, and David Suzuki have come together to share their wisdom and experience of events that have marked the country over the last fifty years. Reflecting on the role of the Senate in Canada as complementary to the House of Commons, they consider central issues such as the condition of indigenous peoples, the obligations of the Charter of Rights and Freedoms, the recognition of two official languages, and the national unity referendums. Contributors also discuss the transformation of the economy in a globalized and digital world, the role of Canada on the world stage at a time of growing tension and an increasing flow of refugees, climate change and the uncertain future of the Arctic, scientific and cultural competitions on the international market, and the future of parliamentary democracy. Correcting misconceptions about the contemporary role of the Senate, and providing a counterargument for radical Senate reform, Reflecting on Our Past and Embracing Our Future offers rich perspectives and fascinating insights about Canada's likely development in the coming years.
