Book excerpt: This volume is the sixth instalment in the Property Law Perspectives Series. Founded by the Young Property Lawyers Forum (www.yplf.net), a global network of young property law scholars, this volume presents the carefully curated highlights of two consecutive conferences held in Hamburg (Max Planck Institute for Comparative and International Private Law, Germany) and in Monterrey (Universidad de Monterrey, Mexico). Property law is often perceived as a static area of study in which there are no developments of significance. This volume proves the contrary. Its contributions address a variety of current issues in property law scholarship, ranging from a critical scrutiny of traditional principles via new developments in selected jurisdictions to the cutting-edge questions of European integration and the digitalisation of property law. It is especially young scholars who are in the best position to bring these new perspectives and topics to the field. This book merits the attention of every student and academic interested in new developments in property scholarship, as well as of legal practitioners looking to place societal developments into a legal context.

Book excerpt: "The Young Property Lawyers Forum is an international network of property law researchers, which has since its inception in 2008 organised seven conferences. Property Law Perspectives V contains a selection of peer reviewed papers presented at the sixth conference of the Young Property Lawyers Forum, which took place at the University of Groningen from 23 to 25 November 2015. The contributors to this book deal with major challenges facing property law in the 21st century, such as inequality, Europeanisation, and property law?s relationship to constitutional law and public law regulation. Also, the contributors seek to solve problems regarding, for instance, acquisitive prescription and condominium rights in one jurisdiction through insights from other jurisdictions. As the motto of the Young Property Lawyers Forum 2015 was "YPLF meets practice", a Dutch practitioner explores property law-related problems surrounding grids in practice and possible legislative solutions to them. The wide variety of topics and jurisdictions make this book a fascinating read for anyone interested in property law."--Back cover.

Available in PDF, EPUB and Kindle. Book excerpt: Conceptualising Property Law offers a transsystemic and integrated approach to common law and civil law property. Property law has traditionally been excluded from comparative law analysis, common law and civil law property being deemed irreconcilable. With this book, Ya'll Emerich aims to dispel the myth that comparison between these two systems of property is impossible. By establishing a dialogue between common law and civil law property, it becomes clear that the two legal traditions share common ground in the way that they address legal, cultural, and social issues related to property and wealth.

Book excerpt: Property Law: Practice, Problems, and Perspectives, Second Edition is a truly contemporary 1L Property text. This book is distinguished by its extraordinarily clear and engaging writing, and by the degree to which the authors make the material accessible and enjoyable to students in this foundational course. The authors embrace the task of training lawyers, and as a result, their text regularly asks students to answer questions and solve problems from the perspective of attorneys. The authors delve fully into legal doctrine and address profound policy issues in a direct and understandable manner, drawing upon an outstanding range of case opinions, including those from seminal cases as well those from recent and provocative disputes. The text uses a two-color design and includes a wonderful selection of photographs. Important documents useful to teaching particular cases and material are reproduced throughout. Property Law: Practice, Problems, and Perspectives is more than just a text. It incorporates a truly unique online simulation that features practice-ready materials and professionally-produced, author-scripted videos that illuminate property law issues and disputes. The text regularly references documents used in practice, which are available to students in the simulation. New to the Second Edition: Revised and updated case opinions and textual discussion. For example: The section addressing the Fair Housing Act now includes a discussion of disparate impact litigation after Texas Dept. of Housing and Community Affairs v. Inclusive Communities Project, Inc. The chapter devoted to takings law now includes summaries of Horne v. Dept. of Agriculture and Murr v. Wisconsin. New and sometimes startling images, such as a subdivision-marketing poster from San Diego in 1915 that offers a frightening example of pervasive discriminatory housing practices that existed prior to the Fair Housing Act. Enjoyable new problems drawn from reported case opinions. For example, the problem of “The Obstinate Ex,” involving a couple who live together in a home owned individually by one of them. When that person breaks off the relationship, the other refuses to move out, claiming an interest in the property. Professors and students will benefit from: A blend of property doctrine and real-world practice, featuring a stimulating, challenging presentation that is also transparent. The book retains the subtlety of the classic texts but comments explicitly on the overlapping elements to ensure that students can see all the connections among legal doctrines. A unique interactive element that teaches students how to read a land survey, helping them understand the issues presented by the text in case opinions and problems. The transactional perspective adopted by the authors in relevant chapters, such as real estate transactions and landlord/tenant law. A unique border along the edge of the text in the chapter on the real property transaction, allowing students to place key concepts and doctrinal material in the context of phases of the transaction. A robust electronic version of the casebook, along with online videos and practice-ready materials. A book that is the ideal text for a four-unit course, but includes ample coverage permitting a professor to construct a five- or six-unit course.

Book excerpt: Most national law expositions leave a distinct impression of a naturalistic approach to the categorisation of property. The view advocated in this study is that the accession or severance of things to and from land as a 'natural scientific enquiry' based exclusively on blends of physical attachment to or socially-expressed intention in respect of land is misleading, or, at least, not decisive. National law accounts of the rules governing the distinction of land and goods need recalibrating to take account of the purpose, or the legal reasons, why land is being distinguished from goods. This is well illustrated by the example of standing timber, variously described doctrinally and in the national case-law as integral parts of land or (presently-existing or future) goods. Purpose of classification reveals the many nuances of competing policy considerations and, in turn, better reflects the law as it stands. The same principles may be applied to the case-law of the CJEU.

Book excerpt: "The Sixth Edition tracks contemporary trends in property law with particular attention to emerging issues of environmental sustainability. The problem-based structure of the casebook comports with the student learning outcomes and assessment approach emphasized in recent years by the American Bar Association and the Carnegie Endowment Report. This edition also provides a comprehensive introduction to intellectual property law. The novel legal problems raised by advances in technology demand that students receive early exposure to this area of law. This edition also emphasizes a planning perspective since lawyers spend a significant amount of time planning, as well as resolving controversies."--Publisher's website.
