The long ascendancy of pluralism and 'collective laissez-faire' as a guiding ideology of British labour law was emphatically shattered by the New Right ideology of Thatcher and Major. When New Labour was finally returned to power in 1997, it did not, however, attempt to resurrect the pre-Thatcher preference for pluralist non-intervention in collective industrial relations. Instead, it purported to follow a 'Third Way'. A centrepiece of this new approach was the statutory recognition provision, introduced in Schedule A1 TULRCA 1992. By breaking with the tradition of voluntarism in respect of recognition of trade unions, New Labour sought to provide a model of collective labour law which combined legal support with control through juridification. A closer study of both the history of approaches to recognition and the current provisions opens up fundamental questions as to the nature of this new model and the ones it aimed to replace. This book uses political philosophy to elucidate the character of those historical approaches and the nature of the 'Third Way' itself in relation to statutory union recognition. In particular, it traces the progressive eclipse of civic republican values in labour law, in preference for a liberal political philosophy. The book articulates and defends a civic republican philosophy in terms of freedom as non-domination, the intrinsic value of democratic participation through deliberative democracy, and community. This can be contrasted with the rights-based individualism and State neutrality characteristic of the liberal approach. Despite the promise of civic community in the 'Third Way' rhetoric, this book demonstrates that the reality of New Labour's experiment in union recognition was an emphatic reassertion of liberalism in the sphere of workers' collective rights. This is the first monograph to offer a sustained critical analysis of legal approaches to trade union recognition. It will be of particular interest to labour lawyers, but also a wider audience of scholars in political philosophy and industrial relations.

Yet, there is very little systematic and empirical research into the effects of union mergers on the unions actually merging or of their impact on the wider union movement. This ground-breaking study fills this gap with its in-depth analysis of British unions' mergers since 1978: the point at which British unions moved from growth into decline, primarily due to adverse and damaging changes in the British industrial relations climate. Initially the book describes the merger processes (transfers and amalgamations) and the extent of British unions' merger activities. This is placed in context by an examination of the generally hostile environment in which such mergers were sought and concluded. The different non-merger strategies adopted by unions to mitigate their membership loss and reduced political status are also assessed. In the body of the text the focus is on: the factors shaping unions' merger searches; the consequent merger negotiations; and the merged unions' subsequent performance. Because of the distinctly different opportunities for reform offered by transfers, as against amalgamations, the book examines each, in turn, in Parts 2 and 3. The interpretative framework adopted for analysing transfers and amalgamations addresses the following elements of unions' interests: members' job territories; political objectives and means; democratic ethos and government; administration (including finance); and leaders' imperatives. Drawing on a wealth of material gathered over the past 20 years via surveys, interviews and action research the different purposes and performances of the merged unions are critically assessed. It is concluded that transfers served to generate a limited range of improvements, generally of advantage to the minor partner union. In contrast, amalgamations are found to have the potential to transform many aspects of union organisation. However, in practice, they also tended to generate a number of unintended and unwelcome consequences. In conclusion mergers' contributions to the revitalization of the wider British trade union movement are also discussed. This authoritative study of British unions' merger strategies is essential reading for all those interested in the future of trade unions and the potential mergers offer for generating significant reforms. Academics and students in employee relations, industrial relations, HRM and labour history should also find it useful for increasing their understanding of how unions have responded to changes in the economic and political context. Policy makers and union practitioners should also gain insights into the kinds of problems associated with unions'structural reforms.

He argues that engineers should not be seen as members of a glamorous 'new class' of professionalized knowledge workers, nor as a radicalized 'new working class' or partially de-skilled technical proletariat. Rather, they should be viewed as 'trusted employees,' selected, socialized, trained, and rewarded to perform the discretionary tasks necessarily delegated by employers in the complex organizations of advanced capitalism. The book draws extensively on observations and interviews to compare engineers' work and understanding in the high- and low-tech settings of two British companies: "Computergraph," an advanced electronics firm, and "Metalco," a traditional British engineering giant. Whalley compares the technical work structure of Britain with those of France and the United States. He argues that the impact of technological change on class structure is critically mediated by nationally specific modes of organizing technical work and producing trusted workers. The book goes beyond cultural explanations of these national variations to examine how they are created and reproduced in the organization of work and the structuring of occupations.
