****************** In October 2016, the Council of Bars and Law Societies of Europe (CCBE) organised a conference on “Innovation and the Future of the Legal Profession”. Book excerpt: This investigation not only revises what historians have long thought of the attitude of barristers toward the French Revolution, but also offers insights into the corporate character of Old Regime society and how the Revolution affected it. Fitzsimmons's study suggests that many propertied commoners during the Revolution were not politically engaged, that they were not necessarily associated with a party or cause simply because of their place within a set of social relationships.

Book Synopsis The First Women Lawyers by : Mary Jane Mossman
Download or read book The First Women Lawyers written by Mary Jane Mossman and published by Bloomsbury Publishing. This book was released on 2006-05-31 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comparative study explores the lives of some of the women who first initiated challenges to male exclusivity in the legal professions in the late-nineteenth and early-twentieth centuries. Their challenges took place at a time of considerable optimism about progressive societal change, including new and expanding opportunities for women, as well as a variety of proposals for reforming law, legal education, and standards of legal professionalism. By situating women's claims for admission to the bar within this reformist context in different jurisdictions, the study examines the intersection of historical ideas about gender and about legal professionalism at the turn of the twentieth century. In exploring these systemic issues, the study also provides detailed examinations of the lives of some of the first women lawyers in six jurisdictions: the United States, Canada, Britain, New Zealand and Australia, India, and western Europe. In exploring how individual women adopted different legal arguments in litigated cases, or devised particular strategies to overcome barriers to professional work, the study assesses how shifting and contested ideas about gender and about legal professionalism shaped women's opportunities and choices, as well as both support for and opposition to their claims. As a comparative study of the first women lawyers in several different jurisdictions, the book reveals how a number of quite different women engaged with ideas of gender and legal professionalism at the turn of the twentieth century.
Download or read book Exclusions written by Julie Fette and published by Cornell University Press. This book was released on 2012-03-27 with total page 328 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the 1930s, the French Third Republic banned naturalized citizens from careers in law and medicine for up to ten years after they had obtained French nationality. In 1940, the Vichy regime permanently expelled all lawyers and doctors born of foreign fathers and imposed a 2 percent quota on Jews in both professions. On the basis of extensive archival research, Julie Fette shows in Exclusions that doctors and lawyers themselves, despite their claims to embody republican virtues, persuaded the French state to enact this exclusionary legislation. At the crossroads of knowledge and power, lawyers and doctors had long been dominant forces in French society: they ran hospitals and courts, doubled as university professors, held posts in parliament and government, and administered justice and public health for the nation. Their social and political influence was crucial in spreading xenophobic attitudes and rendering them more socially acceptable in France. Fette traces the origins of this professional protectionism to the late nineteenth century, when the democratization of higher education sparked efforts by doctors and lawyers to close ranks against women and the lower classes in addition to foreigners. The legislatively imposed delays on the right to practice law and medicine remained in force until the 1970s, and only in 1997 did French lawyers and doctors formally recognize their complicity in the anti-Semitic policies of the Vichy regime. Fette's book is a powerful contribution to the argument that French public opinion favored exclusionary measures in the last years of the Third Republic and during the Holocaust.

Book Synopsis Law, City, and King by : Michael P. Breen
Download or read book Law, City, and King written by Michael P. Breen and published by University Rochester Press. This book was released on 2007 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: An in-depth examination of political activities in early modern France that opens up new perspectives on the local workings of the French state and the experiences of those who participated in it.Law, City, and King provides important new insights into the transformation of political participation and consciousness among urban notables who bridged the gap between local society and the state in early modern France. Breen''s detailed research shows how the educated, socially-middling avocats who staffed Dijon''s municipality used law, patronage, and the other resources at their disposal to protect the city council''s authority and their own participation in local governance. Drawing on juridical and historical authorities, the avocats favored a traditional conception of limited "absolute" monarchy increasingly at odds with royal ideology. Despite their efforts to resist the monarchy''s growth, the expansion of royal power under Louis XIV eventually excluded Dijon''s avocats from the French state. In opening up new perspectives on the local workings of the French state and the experiences of those who participated in it, Law, City, and King recasts debates about absolutism and early modern state formation. By focusing on the political alienation of notables who had long linked the crown to provincial society, Breen explains why Louis XIV''s collaborative absolutism did not endure. At the same time, the book''s examination of lawyers'' political activities and ideas provides insights into the transformation of French political culturein the decades leading up to the French Revolution.
