****************** In October 2016, the Council of Bars and Law Societies of Europe (CCBE) organised a conference on “Innovation and the Future of the Legal Profession”. The conference addressed such questions as: how will the legal profession evolve or reinvent itself to be an essential part of its future? Can the profession’s core values be upheld whilst adapting to these challenges? Who are the key players innovating and positioning the legal profession in an ever-changing environment? How are European lawyers responding to these questions? This CCBE book is the resulting collection of essays by the expert speakers, elaborating their ideas and thoughts on their respective topics into compelling articles.

Book excerpt: This book is a collective volume of studies on the recent legislative developments in European Company Law as well as on topical legal issues that affect companies but which have not been harmonized yet. The Mobility Directive has introduced important amendments to the cross border operations of companies while the Directive on the Digitalisation of Company Law has brought about changes in the setting up of businesses and the use of digital tools and processes throughout the lifecycle of companies. The authors present and thoroughly analyses in their studies the important aspects of these new provisions and the challenges they present in their implementation. The book further explores the future of EU Company Law in particular regarding sustainable corporate governance, director’s duties, letterbox companies and the possible harmonization of the rules regulating groups of companies in the EU. All legal issues are presented very comprehensively and the authors who are academics and legal practitioners are shedding light on complicated legal questions in a very clear way.

Book excerpt: On 17 December 2009, the European Commission for the Efficiency of Justice of the Council of Europe adopted the Guidelines for a better implementation of the existing recommendation of the Council of Europe on enforcement. These principles aim to guarantee to all the access to an enforcement agent and a quality enforcement in the respect of the fundamental rights of the litigants. In the first part of the book, reference is made to the genesis of the CEPEJ Guidelines on Enforcement as well as to its state of application in the various Council of Europe Member States. The second part of the book deals with the problem of the evolution of technologies and aims to question how artificial intelligence can be put at the service of enforcement. In this respect, the analysis focuses on the importance of both electronic access to information and access to dematerialised information, to highlight the imperative need for a procedure for seizure of dematerialised assets and to consider drafting the a crypto-currency attachment procedure.

Available in PDF, EPUB and Kindle. Book excerpt: Since the creation of the European market, EU financial regulators have set up a unique model of different passports for financial products and services. The EU concept of the financial passport has been a real innovation in the realm of international finance. This advanced legal tool is becoming more and more important in the world fund industry. This book is the first to address this topic. It is a unique reference work that gives a holistic view of the development of the financial passport inside and outside the EU. As a concise handbook, it offers a clear idea of the concept and reviews all financial passports throughout the world. It also assists the reader in using the relevant passports by providing quick access to various legal references. In addition, it offers a historical overview of different financial passports and describes the evolution of the operational processing and its impact on the value chain. Moreover, this version contains a specific part dedicated to third countries, including paths that might be used after the Brexit. The book is intended for lawyers, students and those wishing to expand their knowledge. The author is a senior consultant to a major European banking group. As part of business management studies in Paris and New York, he developed a forwardlooking vision for financial passports and has notably supported South American financial regulatory authorities. He established, among others, a dedicated global passport service with a capacity of more than five hundred administrated financial vehicles. In line with regulatory developments, particularly in the EU, he is supporting founders of important funds who are interested in using passports to gain a competitive advantage and grow faster.

Book excerpt: This collection examines recent developments in the legal profession in Europe and in the United States, from a comparative and historical perspective. Apart from discussing the legal profession in general, specific attention is paid to the Latin Notary, the Advocates, the Rechtspfleger, the State Attorney, court experts, and mediators and arbitrators. The topics addressed include: the decline of 'Big Law' in the US * the classification of court experts as legal professionals in Italy * the demise of anti-competitive measures in the modern legal services market * the question of whether mediators should be classified as 'new' legal professionals, given the fact that mediation services are currently being offered by many of the 'old' legal service providers. The volume concludes with a look at the collaboration of various legal professions in providing for the needs of legal practice. (Series: Ius Commune Europaeum - Vol. 95)

Book excerpt: This book takes a completely new and innovative approach to analysing the development of EU law. Within the framework of different important areas of EU law, such as the internal market, consumer protection law, social law, investment law, environment law, migration law, legal translation and terminology, it examines the Union’s approach to the regulation and management of legal risks. Over the years, the Union has come to a point where it is becoming increasingly difficult to justify its authority to regulate in various areas of law. In managing legal risks deriving from the diversity of Member States’ laws, which create barriers to trade and hinder the Union’s economy, the Union itself has actually produced new legal risks that now have to be addressed. This failure on the part of EU institutions to manage legal risks has contributed to legal uncertainty for actors operating on the internal market. This book intends to contribute to the Union’s smoother functioning and continuing development by proposing effective concrete solutions for managing the legal risks distorting the development of various areas of EU law. It pursues an innovative and effective approach to identify legal risks, their causes at the EU level and their impacts on the functioning of the Union and its Member States. By presenting new approaches in this context, the first book on legal risk management in the EU will actively promote the improvement of the EU lawmaking process and the application of EU law in practice.

Available in PDF, EPUB and Kindle. Book excerpt: This unique and timely book analyses the problem of financing civil litigation. The expert contributors discuss the legal possibilities and difficulties associated with several instruments - including cost shifting, fee arrangements, legal expense insurance and group litigation. The authors assess the impact of these instruments from a law and economics perspective and provide empirical information on the way in which they work in practice. A transatlantic perspective on financing civil litigation is also provided. New Trends in Financing Civil Litigation in Europe reveals that as well as improving access to justice, several instruments have the potential to screen cases based on their quality. The book also shows how the choice of instrument can affect the behaviour of actors throughout the litigation process.
