The agricultural sector in CEE definitely has not embraced the family farm as the dominant farming structure, thus confounding the original expectations of Western experts. On the other hand, agriculture did not collapse because of fragmentation and privatization, as predicted by conservative doomsayers. To address the concerns of the farming sector in CEE with relation to EU accession, a workshop was held in Warsaw, Poland in June 1999. This volume represents a selection of papers presented at this workshop. It examines the reforms and policy changes necessary in the food and agriculture sectors of the ten countries that have started the accession process for eventual membership in the European Union (Bulgaria, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia, and Slovenia). "We all become better off by joining a larger trading block but the social consequences will be profound: Brits will need to emigrate to the continent to afford a home, Bulgarians will need to make way for them along the Black Sea coast, and title deeds will be reshuffled all over Europe on a giant Monopoly board" writes the author in his preface, before embarking on a dispassionate examination of the beginning of that process of profound change. The opening chapters are devoted to an explanation of how the internal market has created a substantive European land law. Chapter 3 examines the rise of a distinctive European land law, and the development of conflicts principles applying to recovery of land. Chapters 5 to 9 on the marketing and sale of land focus upon Community competence on consumer protection. The decision to treat land as a product like any other in the Unfair Commercial Practices Directive will have wide ranging and far reaching implications and, apart from marketing of land and of timeshares, other chapters deal with conveyancing, contracting and the emerging market in mortgage credit. The book concludes with a miscellany of conflicts rules which are gradually coalescing and form the elements from which a substantive European land law can be forged. A number of topics which it is not possible to cover in detail (VAT, other taxes, environmental controls and agriculture) are touched on briefly, and the same is true of international aspects of trusts and succession.

Book excerpt: Since 2005, the European Union has provided farmers with subsidies that are not linked directly to production of specific crops, through the single payment scheme (SPS), as part of reforms to its common agricultural policy. This book investigates to what extent the SPS has led to the capitalization of support into land values in the EU. Economic theory and empirical findings suggest that the way in which agricultural support is provided to farmers has an influence on land markets. Subsidies tend to become capitalized into land values to some degree, affecting both the sales and rental prices of land. These effects in turn have a bearing on the transfer efficiency of the support and structural change in agriculture. Drawing from a combination of data sources, 11 country and 18 regional studies, this extensive empirical analysis offers preliminary findings of the reaction of EU land markets and asset values to the changes in EU policy.

As with land consolidation, the traditional purpose of land banking has been to support agriculture and rural development by reducing land fragmentation and facilitating the enlargement of farms. In Western Europe, the objectives of land banking have developed over the last decades, and today, in several countries, the instrument is applied in a multi-purpose approach together with land consolidation. In most countries, land banking shares the objectives of land consolidation, which in addition to continued agricultural development, supports the implementation of public projects in rural areas where private landowners and farmers are requested to give up agricultural land, for example, in connection with the construction of infrastructure projects such as highways and railways or for the implementation of public projects related to nature restoration, afforestation or climate change adaptation and mitigation. In a few Western European countries, land banking is also applied on use rights, where a lease facilitation approach connects owners of agricultural land not using their land and often leaving it abandoned, with local farmers interested in farming more land. This study first analyses and identifies good European practices on land banking, discusses experiences from the introduction of land banking instruments in countries in Central Europe. Finally, it provides policy recommendations for the introduction of land banking, with a focus on countries in Eastern Europe and Central Asia.
