Book excerpt: Excerpt from Principles of the Law of Damages The general purpose of this new book on the law of Damages is like the purpose of the book on the law of Contracts by the same author, to give a complete treatise on the subject in a small volume. All the fundamental principles of the law of Damages are summarized in rules, or propositions of'law. Explanations are given for these propositions of law, with reasons therefor, together with criticisms thereof, whenever in the judgment of the author the rules are the subject of criticism. In order to further elucidate the propositions, copious illustrations are given, showing the application of the same. Under such a plan it is hoped that anyone reading the book will obtain a thorough understanding of the law of Damages. For the convenience of the reader the propositions of law, explanations and illustrations, are printed in different type. The illustrations used are founded upon the cases selected by Professor Beale and by Professor Mechem for their case books on Damages and upon such other cases as the author has deemed it expedient to incorporate in the vdume. Book excerpt: Excerpt from The Civil Liability: For Personal Injuries Arising Out of Negligence In the preparation of the present edition, the text of the work has been revised, all errors discovered corrected, and obsolete and redundant matter expunged. A great amount of new matter has been added under the respective section heads, and a number of supplementary sections inserted. The cases, reported since the publication of the first edition, have been examined, and about seventeen hundred citations from the decisions of the courts of last resort added to the work. Gratefully acknowledging the favor with which the the first edition of the book has been received, the author believes that its thorough revision, and the additions made to it in the present edition, will be found materially to have increased its value, both to the student and the practising lawyer. Book excerpt: Excerpt from A Treatise on the Law of Damages The general plan Of this work is as follows: The first chapter contains a general survey Of the subject; the nine chapters following, a statement and illustration Of elements, principles and rules relating to it; the next ten chapters the law Of damages applicable in cases Of breaches of con tracts; the following fourteen chapters the law of damages in all the various classes of torts; the succeeding one relates to damages under various statutes; the next chapter discusses the subject of nominal damages; and the last treats Of the power and discretion of the court to set aside verdicts for excessiveness or inadequacy. It has been my aim to furnish the practitioner with a useful and convenient treatise, embracing the latest statement Of the law and the most recent authorities; and I entertain a hope that its general usefulness may be largely augmented by the system and method I have pursued. Book excerpt: Excerpt from A Treatise on the Law of Contributory Negligence I have made this book upon the Law of Contributory Negli gence in the belief that such a work, even if only fairly well done, would be timely, and might possibly be, in some degree useful to the bench and bar. The libraries have furnished, hith erto, no separate treatise upon this subject; the latest editions of the standard Works upon the Law of Negligence, which consider Contributory Negligence only incidentally, were published sev eral years ago, and the subject is one of constant, and constantly increasing interest and importance to the profession. It is by far the most important and material branch of the Law of Negli gence, and although we already have at hand, aside from the sev eral English treatises, the three excellent American works of Messrs. Shearman Redfield, Dr. Wharton, and Judge Thomp son respectively - each in its way the best of the three - 1 have thought, because the subject is an interesting one and impinges so much upon so many other leading titles in the law, that this work of mine might supplement rather than supplant what has already been better done upon the more general subject of N egli gence, and that it might, in consequence, turn out not a wholly superfluous undertaking. I have collected and cited more than three thousand cases - not omitting, as I believe, a reference to any valuable adjudication in point, by the State and Federal courts of our own country, and have endeavored to give a due prominence to recent English authorities, and to include, par ticularly, citations from the latest volumes of the reports and from current periodical legal literature. Book excerpt: Excerpt from The Law of Torts: A Treatise on the Principles of Obligations Arising From Civil Wrongs in the Common Law: To Which Is Added the Draft of a Code of Civil Wrongs Prepared for the Government of India My Dear Holmes, A preface is a formal and a tedious thing at best; it is at its worsts when the author, as has been common in law-books, writes of himself in the third person. Yet there are one or two things I wish to say on this occasion, and cannot well say in the book itself; by your leave, therefore, I will so far trespass on your friendship as to send the book to you with an open letter of introduction. It may seem a mere artifice, but the assurance of your sympathy will enable me to speak more freely and naturally, even in print, than if my words were directly addressed to the profession at large. Nay more, I would fain sum up in this slight token the brotherhood that subsists, and we trust ever shall, between all true followers of the Common Law here and on your side of the water; and give it to be understood, for my own part, how much my work owes to you and to others in America, mostly citizens of your own Commonwealth, of whom some are known to me only by their published writing, some by commerce of letters; there are some also, fewer than I could wish, whom I have had the happiness of meeting face to face. Book excerpt: Excerpt from A Treatise on the Law of Torts, or the Wrongs Which Arise Independently of Contract In' preparing the following pages the purpose has been to set forth with reasonable clearness the general principles under which tangible and intangible rights may be claimed, and their disturbance remedied in the law. The book has been written quite as much for students as for practitioners, and if some portions of it are more elementary than is usual in similar works this fact will supply the explanation.
