Book excerpt: Esta obra expone las razones teóricas y conceptuales tendientes a entender si existe en la realidad una primacía del derecho comunitario andino sobre el ordenamiento jurídico nacional y, por consiguiente, establecer la incidencia de este principio en las decisiones del Consejo de Estado como tribunal supremo de lo contencioso administrativo en el ámbito interno. De esta manera, se hace necesario esclarecer los conflictos que se generan como consecuencia de que un Estado sea parte de una organización de integración. El texto se divide en cuatro capítulos en los que se examina el grado de incidencia y vinculación que tienen las decisiones del órgano supranacional en los ordenamientos internos de los Estados; así, se responde a la pregunta: ¿existe un conflicto entre la supremacía constitucional y la primacía del derecho comunitario como resultado de la intención de los Estados de conferir competencias a un órgano supranacional para la consecución de fines comunes? Además, se analiza el mecanismo de la interpretación prejudicial con el fin de poder concluir si este mecanismo verdaderamente es la materialización del principio de primacía del derecho comunitario. Finalmente, desde la perspectiva del principio de primacía del derecho comunitario andino, se analizan algunas de las decisiones emitidas por el Consejo de Estado colombiano, máximo tribunal de lo contencioso administrativo y órgano consultivo del Gobierno, mediante las cuales dicha corporación requirió usar el mecanismo de la interpretación prejudicial para poder emitir sus fallos.

The logic of liberal markets since the 19thCentury, and especially since World War II, has been inscribed into everyday practices that are usually unconsciously reproduced. The Imperial Mode of Living implies that people's everyday practices, including individual and societal orientations, as well as identities, rely heavily on the unlimited appropriation of resources; a disproportionate claim on global and local ecosystems and sinks; and cheap labour from elsewhere. This availability of commodities is largely organised through the world market, backed by military force and/or the asymmetric relations of forces as they have been inscribed in international institutions. Moreover, the Imperial Mode of Living implies asymmetrical social relations along class, gender and race within the respective countries. Here too, it is driven by the capitalist accumulation imperative, growth-oriented state policies and status consumption. The concrete production conditions of commodities are rendered invisible in the places where the commodities are consumed. The imperialist world order is normalized through the mode of production and living.
