Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Available in PDF, EPUB and Kindle. Book excerpt: During the first part of the twenty-first century, bloggers, citizen journalists, social media users, Yelp reviewers, and a myriad of other communicators have found themselves facing defamation, privacy, campaign finance, and other lawsuits as a result of the messages they have communicated. In many ways, these communicators are facing legal questions that are similar to what traditional journalists have faced for centuries regarding their rights to gather and publish information. This book examines how the press clause, a First Amendment freedom with no agreed-upon definition, can be understood in order to help guide the courts and twenty-first-century publishers regarding protecting expression as we move into the fourth wave of networked communication, an era that will be defined by increasingly complex relationships between humans and artificially intelligent communicators. To do so, the book draws upon the discourse theory of communication in democratic society, the legal and foundational history of the press clause, lower-court cases that involve citizen publishers who have claimed protections that have historically been associated with traditional journalism, and established legal and scholarly examinations of artificial intelligence to ultimately construct a framework for how the press clause can be reimagined to protect older and newer generations of publishers.

You are introduced to key legal issues at the start of each chapter, building your critical thinking skills before progressing to real-world landmark cases that demonstrate how media law is applied today. Contemporary examples, emerging legal topics, international issues, and cutting-edge research all help you to retain and apply principles of media law in practice. The thoroughly revised Sixth Edition has been reorganized and shortened to 12 chapters, streamlining the content and offering instructors more opportunities for classroom activities. This edition also goes beyond the judiciary—including discussions of tweets and public protests, alcohol ads in university newspapers, global data privacy and cybersecurity, libel on the internet, and free speech on college campuses—to show how the law affects the ways mass communication works and how people perceive and receive that work.

Ignoring the social value of IP rights and making what others create “free” would be a costly mistake indeed.

Ingelhart presents a comprehensive and useful review of nearly all court cases and legal provisions relating to high school newspapers, yearbooks, and magazines, as well as to the students producing them. The overall concept of a free press as provided for in the First and Fourteenth Amendments is discussed. Related free expression matters are presented as background for understanding the Constitutional protections provided for high school journalists. Court-approved restraints on or regulations of the high school press are examined in depth, as are other forms of expression considered outside First Amendment coverage. Special problems concerning printers, photographers, and suppliers are also considered, as are the legal quandries of advisers. The entire volume is carefully arranged into specific sections for quick and convenient use as a reference source. An annotated alphabetical listing of all cases referred to includes available legal citations and indicates the location of additional information.

It examines how these laws affect public, political and commercial communication. The twelfth edition discusses hot topics such as proposals to modify Section 230 of the Communications Decency Act, net neutrality legislation, participant monitoring, the "actual malice" standard for litigation against journalists and the Julian Assange Espionage Act prosecution. It also explores social media issues, such as whether social media use by public officials constitutes a public forum, liability for defamation and the operation of Facebook’s Oversight Board. The Law of Public Communication is an ideal core textbook for undergraduate and graduate courses in communication law and mass media law. Online resources include a test bank and PowerPoint slides.
