Building on the idea of institutional commitment, which affects the enforcement of decision-making rules, Palanza describes the degree to which countries rely on executive decree authority as more reliance may lead to unbalanced presidential systems and will ultimately affect democratic quality. Breaking new ground by both theorizing and empirically analyzing decree authority from a comparative perspective, this book examines policy making in separation of powers systems. It explains the choice between decrees and statutes, and why legislators are sometimes profoundly engaged in the legislative process and yet other times entirely withdrawn from it.

These diverse assessments arise because we have surprisingly little comparative work on how presidential democracies function. However, in this important new study, political scientist Genevieve M. Kehoe argues that because such chief executives are free from reelection constraint and often still enthusiastic to create a legacy by pursuing bold projects, they may accomplish significant initiatives. Kehoe has developed a concept for this which she calls “Terminal Logic Behavior” (TLB). Presidents and Terminal Logic Behavior: Term Limits and Executive Action in the United States, Brazil, and Argentina provides both case studies and quantitative evidence to show how US presidents of the last three decades have utilized decrees on foreign, domestic, and environment policy during their final months in office. She finds a systematic pattern of decree use consistent with the mark of TLB in a most unexpected place—presidents’ use of national emergency powers. In a careful comparative analysis, she also finds support for her argument in the Argentinean and Brazilian experience of the same period.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. The same can be said of Russia's foreign policy, in particular in relations with former Soviet republics. Any study of Russian foreign policy comes back to the intriguing question of why Russia, long perceived as an inveterate imperial power, would refuse to take back a handsome portion of its former empire - a portion that offers a bridge to Europe and an advantageous geostrategic position. Despite formal declarations, Russia has made little progress in achieving union with its ex-Soviet neighbour, Belarus. Linking Russia's foreign policy to its domestic politics, Alex Danilovich clarifies this paradox and explains why specific attempts to reunify Russia and Belarus failed, contrary to the desires of significant forces on both sides and to certain theory-based expectations.

Book excerpt: Based on the policy-making structures of Venezuelan government, this book examines the constitutionally allocated powers of the executive and legislature and shows how the powers of each branch are exercised given the incentives established by the electoral system and changing partisan strengths. Several institutional characteristics have led to a passive legislature and an activist chief executive. The advantages presidents enjoy as a result of their constitutional and partisan powers are demonstrated by a wealth of empirical evidence, including records of votes of censure, initiation of legislation, and the use of decree authority. Because of its dominance, the Venezuelan executive branch is the focus of interest-group pressure, which is institutionalized through consultative commissions and a decentralized public administration. The author analyzes memberships of more than 300 advisory commissions and governing boards, revealing the preponderance of posts filled by umbrella agencies for business and labor. The interaction of this limited version of civil society with policy makers in the executive branch has led to a highly protectionist development strategy and excessive government subsidies. The strategy and the political process that made it possible were both exhausted by the end of the 1980s. Venezuela was in political and economic crisis. The author places Venezuela in a comparative context with other Latin American states on three issues: the likelihood that executives will receive disciplined, majority support in the legislature; the constitutional powers of presidents; and the degree to which business and labor are formally incorporated through single peak associations. Participation and policy-making processes vary significantly across Latin American democracies, with few others reaching the level of centralization that has characterized Venezuela. At the other end of the spectrum, some Latin American institutional designs are characterized by diffusion and fragmentation. In conclusion, the author offers a blueprint to modify some of the counterproductive patterns associated with Venezuela, one of the longest-lived but now troubled democracies in Latin America.
