Available in PDF, EPUB and Kindle. Book excerpt: Although there is no international government, and no global police agency enforces the rules, nations obey international law. In this provocative study, Franck employs a broad range of historical, legal, sociological, anthropological, political, and philosophical modes of analysis to unravel the mystery of what makes states and people perceive rules as legitimate. Demonstrating that virtually all nations obey most rules nearly all of the time, Franck reveals that the more legitimate laws and institutions appear to be, the greater is their capacity for compliance. Distilling those factors which increase the perception of legitimacy, he shows how a community of rules can be fashioned from a system of sovereign states without creating a global leviathan.

Book excerpt: This unique book, formed as a series of essays in honour of the memory of Paul Heim CMG, the founder of Lincoln's Inn European Group, focusses on the building of bridges between individuals and institutions in European, international, and human rights law. The book features contributions from some of the foremost current or former European and international judges; leading practitioners and officials, each with links to Lincoln's Inn, and former recipients of Lincoln's Inn's dedicated scholarship programmes. The approachable style of the book makes it readily accessible for a wide range of readers including legal scholars, practitioners, students, and those with a general interest in the application of the law and justice in today's interconnected world. Each contribution provides personal reflections and expertise on selected aspects of European and human rights law, and the personal, professional, and technical bridges involved in their development and maintenance, together with insights into their future. The book provides multi-level perspectives on the Court of Justice of the European Union, the EFTA Court, the European Court of Human Rights, and the International Criminal Court, and the interaction of their jurisprudence with domestic law and between themselves, alongside our ever-evolving societies.

Available in PDF, EPUB and Kindle. Book excerpt: The migration movements of the 20th century have led to an increased interest in similarly dramatic population changes in the preceding century. The contributors to this volume - legal scholars, sociologists, political scientist and historians - focus on migration control in the 19th century, concentrating on three areas in particular: the impact of the French Revolution on the development of modern citizenship laws and on the development of new forms of migration control in France and elsewhere; the theory and practice of migration control in various European states is examined, focusing on the control of paupers, emigrants and "ordinary" travelers as well as on the interrelationship between the different administrative levels - local, regional and national - at which migration control was exercised. Finally, on the development of migration control in two countries of immigration: the United States and France. Taken altogether, these essays demonstrate conclusively that the image of the 19th century as a liberal era during which migration was unaffected by state intervention is untenable and in serious need of revision.

Available in PDF, EPUB and Kindle. Book excerpt: This volume deals with the non-governmental part of international sports law. Included are basic documents of an institutional nature, i.e. the Statutes/Constitutions, etc., of universal sports organisations. Two main categories of universal sports organisations are represented in this work: the international `umbrella' organisations, not limited to any single sport, and the so-called international sports federations which are organised for each branch of sport, insofar as they concern Olympic sports. The collection of documents was realised within the framework of the T.M.C. Asser Instituut's research project on international sports law and with the cooperation of the International Olympic Committee. It provides an invaluable source of reference for both legal practitioners, including courts dealing with sports-related cases, and the academic world. With the increase in public interest in the legal aspects of sports, this collection will prove a timely and welcome addition to the scarce collections of materials already available.

Available in PDF, EPUB and Kindle. Book excerpt: First published in 1958, Russian Political Institutions is intended primarily to meet the need of university students for a good account of the political institutions of the Soviet Union in terms similar to those used in their study of other countries. Though the unique comprehensiveness of the Soviet state’s concerns, to which the book draws attention, precludes a formally comparative approach, the ways in which its business is done can be explained, as elsewhere, by the country’s circumstances and historical experience. The first chapter indicates something of these circumstances and experience and of the motives of the Soviet state. The second explains the way the distinctive institutional form of the Soviet state came into being and the process by which it assumed some of the conventional state machinery. The third examines this conventional state and its unconventional functions in a Russian Communist setting. The fourth concerns the structure and operation of the complex device called the Party. The fifth, in turn, examines the means evolved for the fulfillment of the state’s main task, the management of the fully nationalized economy as a single concern, and the other main systems of control, including the judicial system. The sixth chapter suggests briefly how priorities of tasks are decided upon, obligations determined, and their performance secured. This is a must read for students and scholars of Russian history and Soviet politics.

Available in PDF, EPUB and Kindle. Book excerpt: The Slovak Dilemma is a case-study in nationalism. Accepting the view that the four and a half million Slovaks who inhabit the eastern part of Czechoslovakia are a separate Slav ethnic group, Dr Steiner describes their position in Czechoslovak history, their role in political life, the extraordinary persistence and continuing frustration of their national aspirations. After a brief survey of the history of the Slovaks under Hungarian rule, Dr Steiner examines their position in the democratic Czechoslovak Republic which was established in 1918. He analyses the causes of Slovak discontent and shows that although the new constitution granted full expression to Slovak culture, it limited complete development of Slovak national rights. Nevertheless he suggests that Slovak separatism played little part in the dismemberment of Czechoslovakia in 1938 and that the real attitude of the people towards Hitler's puppet Slovak State was eloquently expressed in their tragic rising against it in August 1944.

Book excerpt: The current political, economic and financial crises facing the EU reveal a deeper cultural, indeed spiritual, malaise – a crisis in ‘the soul of Europe’. Many observers are concluding that the ‘soul of Europe’ cannot be restored to health without a new appreciation of the contribution of religion to its past and future, and especially that of its hugely important but widely neglected Christian heritage, which is alive today even amidst advancing European secularization. This book offers a fresh, constructive and critical understanding of Christian contributions to the origin and development of the EU from a variety of theological and national perspectives. It explains the Christian origins of the EU, documents the various ways in which it has been both affirmed and critiqued from diverse theological perspectives, offers expert, theologically-informed assessments of four illustrative policy areas of the EU (trade, finance, environment, science), and also reports on the place of religion in the EU, including how religious freedom is framed and how contemporary religious (including Muslim) actors relate to EU institutions and vice versa. The book fills a major gap in the current debate about the future of the European project and will be of interest to students and scholars of religion, politics and European studies.
