Brobbey and published by Blackmask. This book was released on 2000 with total page 752 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work covers practice and procedure in the High Courts, the Regional Tribunals, the circuit courts, the circuit tribunals, the district courts and the community tribunals in Ghana. The author elucidates the structures of these institutions, and the relationships between them. He stresses the importance of the district courts, and community tribunals which remain for the most part unrecognised - undeservedly so, he maintains, since they form the building blocks of the Ghanaian legal system and a training ground for the country's lawyers. He discusses the role of the magistrate and the need for better magisterial guidance to make these courts effective.

Available in PDF, EPUB and Kindle. Book excerpt: The book 'Appellate Practice in Ghanaian Courts (Principles and Procedure)' provides a very useful guide to the practice of appeals, especially civil appeals in the Superior Courts of Ghana. It is not limited to appeals in the Court of Appeal, but appeals from district court to the High Court, appeals from circuit court to the Court of Appeal, appeals from the High Court, appeals from the Court of Appeal and appeals to the Supreme Court. Circumstances under which the Supreme Court will grant special leave in exercise of its jurisdiction conferred on Article 131(2) of the Constitution 1992, has been dealt with in this book. Recent decisions mostly from the Supreme Court and the Court of Appeal have been incorporated to make it reader friendly and easy to understand. Relevant statute and rules like the Courts Act (Act 459), 1993, the Supreme Court Rules, 1996 (CI 16), the Court of Appeal Rules, 1997 (CI 19) and some provisions on appeal in the High Court (Civil Procedure), 2004 (CI 47) have been added to enrich the contents of this book. This book, a worthy contribution to legal knowledge and literature, will, indeed, enrich the jurisprudence of appeals. It will go a long way to enhance the quality of our legal system and be of tremendous assistance to judges and practitioners alike. Its contents reflect the author's undoubted learning and attention to details. On the whole, it is hoped that the book will provide a helpful contribution to the enhancement of civil appellate practice in the Ghanaian courts.

Book excerpt: Available Open Access under CC-BY-NC licence Effective participation in court and tribunal hearings is regarded as essential to justice, yet many barriers limit the capacity of defendants, parties and witnesses to participate. Featuring policy analysis, courtroom observations and practitioners’ voices, this significant study reveals how participation is supported in the courts and tribunals of England and Wales. Including reflections on changes to the justice system as a result of the COVID-19 pandemic, it also details the socio-structural, environmental, procedural, cultural and personal factors which constrain participation. This is an invaluable resource that makes a compelling case for a principled, explicit commitment to supporting participation across the justice system of England and Wales and beyond.

Book excerpt: Traditional separation of powers theories assumed that governmental despotism will be prevented by dividing the branches of government which will check one another. Modern governments function with unexpected complicity among these branches. Sometimes one of the branches becomes overwhelming. Other governmental structures, however, tend to mitigate these tendencies to domination. Among other structures courts have achieved considerable autonomy vis-à-vis the traditional political branches of power. They tend to maintain considerable distance from political parties in the name of professionalism and expertise. The conditions and criteria of independence are not clear, and even less clear are the conditions of institutional integrity. Independence (including depolitization) of public institutions is of particular practical relevance in the post-Communist countries where political partisanship penetrated institutions under the single party system. Institutional integrity, particularly in the context of administration of justice, became a precondition for accession to the European Union. Given this practical challenge the present volume is centered around three key areas of institutional integrity, primarily within the administration of justice: First, in a broader theoretical-interdisciplinary context the criteria of institutional independence are discussed. The second major issue is the relation of neutralized institutions to branches of government with reference to accountability. Thirdly, comparative experience regarding judicial independence is discussed to determine techniques to enhance integrity.

Book excerpt: This book offers the first comprehensive and in-depth analysis of the provisions of the ‘Malabo Protocol’—the amendment protocol to the Statute of the African Court of Justice and Human and Peoples’ Rights—adopted by the African Union at its 2014 Summit in Malabo, Equatorial Guinea. The Annex to the protocol, once it has received the required number of ratifications, will create a new Section in the African Court of Justice and Human and Peoples’ Rights with jurisdiction over international and transnational crimes, hence an ‘African Criminal Court’. In this book, leading experts in the field of international criminal law analyze the main provisions of the Annex to the Malabo Protocol. The book provides an essential and topical source of information for scholars, practitioners and students in the field of international criminal law, and for all readers with an interest in political science and African studies. Gerhard Werle is Professor of German and Internationa l Crimina l Law, Criminal Procedure and Modern Legal History at Humboldt-Universität zu Berlin and Director of the South African-German Centre for Transnational Criminal Justice. In addition, he is an Extraordinary Professor at the University of the Western Cape and Honorary Professor at North-West University of Political Science and Law (Xi’an, China). Moritz Vormbaum received his doctoral degree in criminal law from the University of Münster (Germany) and his postdoctoral degree from Humboldt-Universität zu Berlin. He is a Senior Researcher at Humboldt-Universität, as well as a coordinator and lecturer at the South African-German Centre for Transnational Criminal Justice.

Book excerpt: International courts and tribunals are key actors in international law, both because of their primary dispute resolution function and for their role in developing international law in a more general sense. Their growing number and complexity makes a detailed study of their practice particularly relevant. The Rules, Practice, and Jurisprudence of International Courts and Tribunals examines existing international dispute resolution institutions, including those of general jurisdiction (ICJ, PCA), specialised jurisdiction (ITLOS, ICSID, WTO), as well as human rights courts, international criminal courts and tribunals, courts of regional integration agreements, claims commissions and tribunals, and administrative tribunals of international organizations. Uniquely, it assesses both procedural rules and essential case-law, making it relevant for both academics and practitioners in international law.
