Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Equity and Its Remedies This book is the outcome of lectures delivered by the author at the Evening Law School of the Boston Y. M. C. A. And at the Law School of Boston Univer sity, on the equitable remedies. The justification for putting the material in this form is found in the expressions of gratitude from former students who have been good enough to say that they have found in these lectures citations and statements of principles inaccessible in any text-book. The frequency with which the author has turned to these notes for cita tions in his own practise has convinced him that others of the profession may be able to find assistance from the same source. The book is an attempt to give a rational outline of equity (exclusive of trusts and kindred subjects) and to show the scope of the equitable remedies. It does not attempt to deal with strictly statutory subjects or with equity pleading or practice. While the citations are largely drawn from Massa chusetts cases (and Ames's Cases on Equity), it is believed the subject is treated in such a way as to make the book of general application, useful to the student or practitioner in any part of the United States. No attempt has been made to cite all the equity cases decided in Massachusetts, although cer tain parts of the subject, not covered by existing text-books, have been treated with thoroughness. Special attention has been given to late cases. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Studies in the Contract Laws of Asia provides an authoritative account of the contract law regimes of selected Asian jurisdictions, including the major centres of commerce where until now, limited critical commentaries have been available in the English language. In this new six part series of scholarly essays from leading scholars and commentators, each volume will offer an insider's perspective into specific areas of contract law, including: remedies, formation, parties, contents, vitiating factors, change of circumstances, illegality, and public policy, and will explore how these diverse jurisdictions address common problems encountered in contractual disputes. Concluding each volume will be a closing discussion of the convergences and divergences throughout eachacross the jurisdictions, and comparisons with European jurisdictions from which Asians well as an overview of the common themes found throughout each jurisdiction .contract law derive. Volume I of this series examines the remedies for breach of contract in the laws of China, India, Japan, Korea, Taiwan, Singapore, Malaysia, Hong Kong, Korea, and Thailand. Specifically, it addresses the readiness of each legal system in their action to insist that parties perform their obligations; the methods of enforcing the parties' agreed remedies for breach; and the ways in which monetary compensation are awarded. Each jurisdiction is discussed over two chapters; the first chapter will examine the performance remedies and agreed remedies, while the second explores the monetary remedies. A concluding chapter offers a comparative overview.

This young research lawyer just can't stop writing. This current book, as the previous ones, is subject-focused and utilises the rich stock of Ghanaian cases on the subject. It is a must-have and a must-read for law students, researchers, lawyers, judges and anyone interested in Ghanaian law on the subject. Derick has once again, placed us in his debt. Eric Baah, Justice of the Court of Appeal. This book "Nutshells, Award of Damages and Equitable Remedies in Ghanaian Courts" is very simplified and easy to understand. It deals with how damages and equitable remedies are to be awarded in our courts. The book offers in-depth knowledge on the subject areas discussed therein. Areas under damages include principles and measure of damages, types of damages and how damages are to be awarded under a breach of contract and in torts. Damages for unlawful dismissal, seduction, malicious prosecution, infringement of copyright and goods etc have been discussed in this book. Under equitable remedies, specific performance, injunction, rectification and rescission have also been dealt with in this book. This is the first of its kind in our legal education in Ghana. For a quick reference guide on these subject areas this book is probably the best book available. It is a practical cause book intended to assist primarily lawyers, judges and students of law.

Available in PDF, EPUB and Kindle. Book excerpt: "This book describes and explains the failure of the federal courts of the United States to act and to provide remedies to individuals whose constitutional rights have been violated by illegal state coercion and violence. This remedial vacuum must be understood in light of the original design and historical development of the federal courts. At its conception, the federal judiciary was assumed to be independent thanks to an apolitical appointment process, a limited supply of adequately trained lawyers (which would prevent cherry-picking), and the constraining effect of laws and constitutional provision. Each of these checks quickly failed. As a result, the early federal judicial system was highly dependent on Congress. Not until the last quarter of the nineteenth century did a robust federal judiciary start to emerge, and not until the first quarter of the twentieth century did it take anything like its present form. The book then charts how the pressure from Congress and the White House has continued to shape courts behaviour-first eliciting a mid-twentieth-century explosion in individual remedies, and then driving a five-decade long collapse. Judges themselves have not avidly resisted this decline, in part because of ideological reasons and in part out of institutional worries about a ballooning docket. Today, as a result of these trends, the courts are stingy with individual remedies, but aggressively enforce the so-called "structural" constitution of the separation of powers and federalism. This cocktail has highly regressive effects, and is in urgent need of reform"--

Book excerpt: "Estoppel is understood at a basic level by many lawyers, but this set of legal doctrines is highly complex and filled with such confusing terminology, such that it poses a challenge for both practitioners and scholars alike. This is the first Canadian text book that clarifies the subject matter from a Canadian legal standpoint, and deals with its complexity and subtleties in a manner that's easily understood. Written by a veteran University of British Columbia law professor, this book pulls together various aspects of estoppel into one place, saving readers valuable research time, while educating them on the rules and principles of estoppel in a clear and organized manner."--Pub. desc.
