Uno sguardo è stato rivolto agli antipodi della crisi di impresa, attualmente rappresentati, ad un estremo, dal procedimento di composizione della crisi da sovraindebitamento (riservata al debitore civile o all’imprenditore non fallibile) e, all’estremo opposto, dalla tradizionale procedura fallimentare. Nel primo caso, al fine di rintracciare possibili - per quanto diafane – manifestazioni della postergazione all’interno della cd. insolvenza civile; nel secondo, per cogliere la valenza polimorfica del credito postergato all’interno delle varie scansioni procedurali del fallimento, specie nella fase dell’accertamento del passivo e nel momento recuperatorio dell’attivo (con tutte le iniziative variamente assumibili dal curatore per recuperare eventuali, improvvidi, rimborsi di finanziamenti societari), ma con brevi incursioni anche nelle logiche del concordato fallimentare, dell’esdebitazione e delle amministrazioni straordinarie. Infine, un’analisi sommaria viene dedicata alle novità previste dal d.l. 22 giugno 2012, n. 83, cd. “decreto crescita” che intersecano più o meno direttamente i temi trattati ne volume.
