Pour y faire face, ce dernier multiplie ses domaines d'intervention, adapte ses outils traditionnels à une réalité de plus en plus complexe et, surtout, révèle une richesse dont on ne le pensait pas capable. Jusqu'alors essentiellement pratique, le droit de la pollution atmosphérique est en effet devenu un droit créateur d'où émergent des principes fondamentaux du droit de l'environnement. Le principe de précaution a ainsi trouvé, avant même d'avoir été défini, ses premiers développement dans le cadre de la lutte contre les pluies acides, puis de la protection de la couche d'ozone. Cette richesse nouvelle du droit de la pollution atmosphérique s'exprime également dans les instruments auquel il recourt (planification, droits d'émission) qui révèlent sans doute une nouvelle perception de l'air, et par extension de l'atmosphère, en tant qu'objet juridique. Jusqu'alors considérée comme un réceptable naturel des déchets de l'activité humaine, l'atmosphère apparaît désormais comme une ressource et pour dire le mot, comme un patrimoine, évolution qui laisse augurer l'imminence d'une reflexion statutaire approfondie.
