Da qui il senso di un’indagine che fotografi lo “stato di salute” dei diritti sociali, primo fra tutti quello al lavoro, per prevenire possibili future criticità in un tempo in cui non solo il diritto previdenziale, storicamente terreno di gioco prediletto di schemi regolativi condizionati, ne subisce le dirette conseguenze, ma ne viene a fortiori attratto l’alveo assistenziale. Filtrando gli istituti delineati dal legislatore ordinario attraverso le lenti dei principi costituzionali, si individuerà il discrimen tra una condizionalità cattiva e una buona: tra un meccanismo regolativo che abbia come fine esclusivo il contenimento della spesa pubblica attraverso il lavoro purchessia e un altro, antropocentrico, che invece metta al centro l’individuo, prima ancora che il potenziale lavoratore, richiedendone certamente operosità, ma coltivandone l’occupabilità come mezzo di sviluppo personale e partecipazione alla vita politica.
