Book excerpt: Loveland (law, City U., London, U.K.) details the historical evolution of English libel law, often in comparison with American legal practice. He argues that vestigial facets of the law are held over from a pre-democratic age and that it unfairly defends the reputations of politicians against the interests of the public. He argues the legal reform needs to take place on the basis of political desirability rather than legal necessity. Distributed by ISBS. Annotation copyrighted by Book News, Inc., Portland, OR

Book excerpt: The political libel is as old as politics itself. The politician, seeking redress in the courts for an allegedly libellous publication, uses the English law of libel to attempt to remove the stain from his character. Wielding the 'sword of truth' he does battle with the media, often with huge attendant publicity, and at great risk to his reputation should he fail in his quest. At the same time he stands to pocket a substantial sum in damages if he can show the libel to have been committed. In this, the first modern study of the phenomenon of political libels, the author delves behind the headlines and looks at the political and legal problems which surround this little understood but controversial area of English law. In this highly readable and engaging work the author surveys the ancient and modern history of the political libel laws, and argues that the English law of libel has in the main been too jealous of defending the reputations of politicians and insufficiently alert to the legitimate interest of the public. A strong case is made for reforming the law substantially, a case which rests both on the experience of other countries (notably the USA), and also on a re-examination of a handful of English cases dating from the mid-to-late nineteenth century whose significance has been downplayed by lawyers in subsequent years.

Book excerpt: Since the 2004 presidential campaign, when the Bush presidential advance team prevented anyone who seemed unsympathetic to their candidate from attending his ostensibly public appearances, it has become commonplace for law enforcement officers and political event sponsors to classify ordinary expressions of dissent as security threats and to try to keep officeholders as far removed from possible protest as they can. Thus without formally limiting free speech the government places arbitrary restrictions on how, when, and where such speech may occur.
Book Synopsis The Politics of the Excluded, c. 1500-1850 by : Tim Harris

Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays seeks to shed light on the politics of those people who are normally thought of as being excluded from the political nation in early modern England. If by political nation we mean those who sat in parliament, the governors of counties and towns, and the enfranchised classes in the constituencies, then the 'excluded' would be those who were neither actively involved in the process of governing nor had any say in choosing those who would rule over them - the bulk of the population at this time. Yet this volume shows that these people were not, in fact, excluded from politics. Not only did the masses possess political opinions which they were capable of articulating in a public forum, but they were alos often active participants in the political process themselves and taken seriously in that capacity by the governmental elite. The various essays deal with topics as wide-ranging as riots, rumours, libels, seditious words, public opinion, the structures of local government, and the gendered dimensions of popular political participation, and cover the period from the eve of the Reformation to the Industrial Revolution. They challenge many existing assumptions concerning the nature and significance of public opinion and politics out-of-doors in the early modern period and show us that the people mattered in politics, and thus why we, as historians, cannot afford to ignore them. Politics was more participatory, in this undemocratic age, than one might have thought. The contributors to this volume show that there was a lively and engaged public sphere throughout this period, from Tudor times to the Georgian era.
Book Synopsis The Accusation: Blood Libel in an American Town by : Edward Berenson
Download or read book The Accusation: Blood Libel in an American Town written by Edward Berenson and published by W. W. Norton & Company. This book was released on 2019-09-10 with total page 206 pages. Available in PDF, EPUB and Kindle. Book excerpt: A chilling investigation of America’s only alleged case of blood libel, and what it reveals about antisemitism in the United States and Europe. On Saturday, September 22, 1928, Barbara Griffiths, age four, strayed into the woods surrounding the upstate village of Massena, New York. Hundreds of people looked everywhere for the child but could not find her. At one point, someone suggested that Barbara had been kidnapped and killed by Jews, and as the search continued, policemen and townspeople alike gave credence to the quickly spreading rumors. The allegation of ritual murder, known to Jews as “blood libel,” took hold. To believe in the accusation seems bizarre at first glance—blood libel was essentially unknown in the United States. But a great many of Massena’s inhabitants, both Christians and Jews, had emigrated recently from Central and Eastern Europe, where it was all too common. Historian Edward Berenson, himself a native of Massena, sheds light on the cross-cultural forces that ignited America’s only known instance of blood libel, and traces its roots in Old World prejudice, homegrown antisemitism, and the resurgence of the Ku Klux Klan in the 1920s. Residues of all three have persisted until the present day. More than just the disturbing story of one town’s embrace of an insidious anti-Jewish myth, The Accusation is a shocking and perceptive exploration of American and European responses to antisemitism.
