Book excerpt: Gli interventi legislativi degli ultimi decenni evidenziano la tendenza a un uso strumentale, simbolico e pletorico della materia penale: la sensazione netta, sotto questo punto di vista, è quella di un diritto penale "militarizzato", fondato cioè sull'esigenza di rendere inoffensive categorie di soggetti socialmente pericolosi (il recidivo, il clandestino, il terrorista), con conseguente crisi dei principi di legalità, materialità e colpevolezza. Il medium che rende possibile questa trasfigurazione è il concetto di sicurezza, inteso come discutibile bene giuridico alla cui stregua arretrare la soglia dell'incriminazione sino a sovrapporre la prevenzione del danno da reato con quella collegata alla neutralizzazione preventiva del presunto criminale. Da condizione necessaria per l'esercizio dei diritti, la sicurezza è assurta essa stessa a diritto, diventando strumento di ampliamento del controllo penale – ispirato da sapienti strategie politico-mediatiche di manipolazione della paura – e d'indebita limitazione dei diritti individuali. Mai come nella definizione della latitudine securitaria si svela un preoccupante accavallamento tra prevenzione e repressione, tra sicurezza dei diritti e diritto alla sicurezza, tra sicurezza come diritto fondamentale e sicurezza come protezione del cittadino da minacce incombenti (reali o artificiali) della natura più diversa. L'Autrice analizza l'espansione incontrollata del concetto di sicurezza alla stregua della normativa penale sull'immigrazione clandestina e sul terrorismo, senza tralasciare i riflessi del ritorno del "diritto penale del nemico" su una società multiculturale in cui l'integrazione torna ad essere miraggio, se non obiettivo indesiderato. La sicurezza è uno dei cardini su cui si fonda il populismo (anche) penale dell'attuale momento storico. Il saggio cerca di comprenderne le cause e di indagarne i possibili, necessari rimedi.
