Este es el contexto que justifica el escrito que el lector tiene en sus manos, y denota que la interacción entre derecho público y privado es una realidad palpable que desmitifica las fronteras fijadas por las diferentes áreas de estudio de la ciencia jurídica, pues la interacción es un doble sentido: mientras que en algunos ámbitos se puede sostener una huida del derecho administrativo, en otros se puede defender una publificación de las instituciones clásicas del derecho privado.

Book excerpt: El libro que me complace presentar es el resultado de la investigación "Medio ambiente y ordenación del territorio" que el Grupo de Investigación en Derecho del Medio Ambiente de la Universidad Externado de Colombia proyectó con el objetivo de identificar y estudiar los conceptos de planificación y plan, así como algunos ejercicios de ordenación del territorio y de planificación ambiental desarrollados en España y en Colombia, con el fin de identificar el marco jurídico y las políticas públicas que se han desarrollado en la materia, y verificar sus logros y dificultades. Antes de describir el contenido y la estructura del documento partimos por indicar que desde el punto de vista terminológico ordenar implica "Colocar algo o a alguien de acuerdo con un plan o de modo conveniente”, "Encaminar y dirigir algo a un fin" (DRAE, 2014). Entendemos que si nos referimos a la ordenación hablamos de un proceso por medio del cual se ordenan las cosas o los elementos de manera tal que, de llevarse a cabo las etapas identificadas en un plan, se logra el fin que previamente se ha proyectado y delimitado. Ahora bien, siendo el territorio la base sobre la cual se desarrollan múltiples actividades humanas que se ejercen conforme a las delimitaciones determinadas por el ordenamiento jurídico sobre el que se construye el Estado social de derecho, es necesario que además de las herramientas definidas en el marco normativo se construyan y desarrollen instrumentos de planificación y ordenamiento del territorio que le permitan al Estado prescribir una serie de procedimientos que lo impulsen a alcanzar sus objetivos sustanciales.
