Une synthèse est ainsi élaborée entre les fondements juridiques de l'argumentation judiciaire et les solutions que la rhétorique ancienne avait apportées, illustrées dans cette deuxième édition enrichie et refondue, par plus de cent exemples tirés des procès les plus célèbres. Tout d'abord, les arguments sont analysés selon leur matière : droit, fait, émotions, valeurs ; leur forme logique : jugement, syllogisme inductif et déductif ; la nature des relations qu'ils posent : contradiction, identité, inclusion, succession ou coexistence. Ensuite, sont abordées les étapes de la construction de l'argumentation judiciaire : détermination de l'objectif, caractéristiques de l'analyse d'un dossier judiciaire, phase de la synthèse argumentative, qualification et interprétation enrichie par la prise en compte nécessaire de l'auditoire. En outre, est traité ce que la rhétorique traditionnelle désignait sous le nom de dispositions du discours judiciaire. Y sont décrites les principales étapes de la plaidoirie : exorde, narration, division, confirmation, réfutation et péroraison. Cette deuxième édition aborde enfin les principes généraux de l'énonciation de l'argumentation judiciaire, et les principes qui en régissent l'expression orale. La cohérence du comportement de l'orateur à l'audience, avec son propos, la renforce. Dans la recherche de la réalisation des droits, ce livre destiné plus particulièrement aux futurs avocats, a le dessein d'éclairer sur la manière de qualifier les données et d'interpréter la norme.
