Book excerpt: The United States Environmental Protection Agency (EPA) has issued regulations to ensure the protection of human health and the environment through the appropriate management of hazardous wastes under Subtitle C of the Resource Conservation and Recovery Act of 1976 (RCRA). Those regulations require most facilities that treat, store or dispose of hazardous waste to obtain a RCRA permit. The application for this permit consists of two parts, Part A and Part B. Facilities in existence before November 1980 were required to submit the Part A application by November 19, 1980. These facilities were granted interim status under the regulations, which permits them to continue operations until final administrative action is taken on their permit. This requires the submittal of a detailed Part B permit application. The permit application must contain sufficient information to assure EPA that the facility design, operation and proposed closure and post-closure plans will satisfy the applicable permitting standards. The Part B process is complex, uncertain and inherently subjective. While the level of uncertainties is decreasing, the applicant can minimize the uncertainties by aggressively managing the process. The applicant must plan his strategy, pay particular attention to details and follow through daily if necessary. The long-term cost savings alone should justify the increased attention given to management of the Part B application process.

Book excerpt: Corrective action is required under the authority of the Resource Conservation and Recovery Act (RCRA) Sections 3004(u) and(v) which were added by the Hazardous and Solid Waste Amendments of 1984 (HSWA). In response to HSWA, the US Environmental Protection Agency(EPA) proposed a comprehensive corrective action program under 40 CFR 264 Subpart S [55 FR 30798, July 27, 1990]. Although Subpart S is still only proposed, it is being implemented by the EPA Regions until the rule is finalized. Proposed Subpart S corrective action applies to releases to any media from any solid waste management unit (SWMU) at a treatment, storage, or disposal facility (TSDF). Corrective action requirements under proposed Subpart S are imposed through permit conditions or, for interim status facilities, through a RCRA Section 3008(h) order. In general, upon initial regulation of a TSDF, the owner or operator submits a Part A permit application, notifying the regulatory agency of waste management activities. The Part A consists of a form containing general information about the facility, the unit(s) affected, and the wastes managed in the units. Part B of the permit application provides detailed information on the facility, the units affected, and the waste managed. The Part B permit application may consist of several volumes of information. Proposed Subpart S requirements, would be contained in the Part B permit application. The Part B permit application proposes requirements and conditions intended to respond to the various RCRA requirements for permitted units. This submittal initiates the negotiation process for regulated SWMUS, whereby the requirements and conditions for unit operation are established. The term of the permit is typically 5 or 10 years, after which a permit renewal or issuance of a new permit is required. This Information Brief provides information on the permit requirements and process under proposed Subpart S.

Book excerpt: Hazardous waste operating permits issued under the Resource Conservation and Recovery Act (RCRA) often impose requirements, typically by reference to the original permit application, that specific components and equipment be used. Consequently, changing these items, even for the purpose of routine maintenance, may first require that the owner/operator request a potentially time-consuming and costly permit modification. However, the owner/operator may demonstrate that a modification is not required because the planned changes are functionally equivalent, as defined by RCRA, to the original specifications embodied by the permit. The Controlled-Air Incinerator at Los Alamos National Laboratory is scheduled for maintenance and improvements that involve replacement of components. The incinerator's carbon adsorption unit/high efficiency particulate air filtration system, in particular, was redesigned to improve reliability and minimize maintenance. A study was performed to determine whether the redesigned unit would qualify as functionally equivalent to the original component. in performing this study, the following steps were taken: (a) the key performance factors were identified; (b) performance data describing the existing unit were obtained; (c) performance of both the existing and redesigned units was simulated; and (d) the performance data were compared to ascertain whether the components could qualify as functionally equivalent.
