PBC allows a state transportation agency (STA) to use an incentive structure to induce the contractor to take a long-term interest in the functionality of the highway without excessive cost to the STA. First, an overview of contract mechanisms and existing PBCs in industry is provided. Then, a summary of performance-based specifications illustrates that contractors can adopt construction and maintenance policies to significantly improve pavement performance. Finally, a framework for choosing PBCs to achieve STAs' goals is provided, with a discussion of some of the difficulties associated with implementation. It can be seen that, in a competitive bidding process, the additional cost of incentives is not larger than the additional value gained by higher-quality work.

The study captured 82 respondents as research sample to a case study of Output Performance - Based Contracts (OPRCs) for the Construction and Maintenance of Gravel Roads in Zambia. Purposive sampling was used as most research participants were drawn from second generation OPRCs that were active between 2009 and 2014. The study was aimed at devising new Construction and Maintenance Contract methods for gravel roads that are based on “Lean Thinking and Value Management” philosophies in Zambia. The established epistemological background to the study is that most of the Zambian road network is of gravel or earth standards and is therefore, imperative that they are well maintained to attain desired service levels to properly serve the intended beneficiaries (the road users). The Road Development Agency Annual Report of 2009 indicated that 33,000 Km of the total 40,671 Km core road network, is classified as gravel roads (unpaved) , which are at the moment mostly in a deteriorated state. The study revealed that currently in Zambia, Gravel Road Construction projects are commonly being realised through the use of traditional Contracts such as admeasured; by the use of Bills of Quantities (BOQs), the Lump sum and Cost plus, etc. These are mainly short term form of Contracts which to some extent, lack some components of sustainable maintenance regimes, thereby rendering the Government and other Promoters efforts futile as gravel roads sooner or later deteriorate just after the first rain season upon their construction. This was theoretical perspective which served as driver to the “Research problem”. The study noted that current forms of Contracts did not inspire, aspire and spur the spirit of ownership as the local people were left out in the planning and design stages of gravel road projects. Despite all the attempts made by Government, through the RDA and other implementing Agencies, the Road Construction Industry in general, has failed to get the best value for money through the use of these conventional types of Contracts. One of the reasons for this failure according to Womack and Jones (2003), ‘is that it is hard to define and realise value, this is partly because most Producers [Road Contractors] want to make what they are already making and partly because Customers only know some variant of what they are already getting’.

Book excerpt: Construction zones can greatly affect the traffic flow on roadways, especially when lane closures are required. Traditionally, the Utah Department of Transportation (UDOT) has used traffic management specifications that only allow lane closures and road work to be done during predetermined hours or specifications that require a certain number of lanes to be open at all times. Recently, mobility-based work-zone traffic flow maintenance has been considered. This method requires continuous monitoring of mobility-based performance data and a mechanism to send alerts to the contractors when the mobility data does not meet the standards set by the specifications. UDOT recently tested mobility-based performance specifications at an urban arterial work zone and studied issues related to implementation of mobility-based performance specifications. Parallel to this experiment, UDOT funded a study to develop guidelines for implementing mobility-based performance specifications to manage traffic flow in work zones. Dynamically collecting mobility-based data such as travel time and speed is now feasible using technologies such as Bluetooth and microwave sensors. The core benefit of using mobility-based performance specifications is that they can give the contractor more flexibility in construction work scheduling while maintaining an acceptable level of traffic flow. If the level of traffic flow is not maintained, then the contractor is assessed a financial penalty. The penalty is determined by the amount of time where the flow is not maintained at a predetermined condition. To discuss issues and develop guidelines, a task force consisting of UDOT representatives, several representatives from the construction industry, and researchers from Brigham Young University was formed. Through three task force meetings, a set of 12 guidelines were developed, including guidelines about when mobility-based performance specifications should be used and which mobility data should be used. Some of the issues were difficult for the task force members to agree on, and a decision-making theory called the Technique for Order Preference by Similarity to Ideal Solution (TOPSIS) was used to find best approaches to deal with some of the difficult issues associated with the implementation of mobility-based performance specifications in highway construction contracts. These guidelines should be reviewed as appropriate in the future as UDOT accumulates experience in using these types of specifications.

This has caused varied reactions from the parties involved in the design and construction of highways, resulting in a General Accounting Office study on methods for improving the quality of federal-aid highways, including the use of warranties. Ultimately, the owner will have to decide whether to use warranties in highway construction projects. Some of the potential benefits and concerns of using warranties, plus needed actions for successful implementation are presented in this synthesis, which is considered a snapshot of the issues at the time of publication.
