Book excerpt: Few pieces of legislation have had more of an effect on public education in recent years than Title IX of the 1972 Education Amendments. Female athlete participation has increased considerably as a result of this regulation. The purpose of this study, which was conducted in the state of Texas, was to find out how athletic directors—male and female head coaches—felt about their campuses’ compliance with Title IX components. The study focused on the results of a survey instrument that included 14 Likert-scale items and a number of demographic questions. The goal of this study was to (a) look at how athletic directors and head coaches of both male and female athletes perceive their school district’s level of Title IX compliance, and (b) look at specific patterns that determine whether Texas school districts are in compliance or noncompliance with specific Title IX provisions. The law focuses on equality in athletic opportunities under the following situations: (a) the choice of sports and performance levels (i.e., the successful accommodation of the desires and skills of members of both sexes); (b) the provision of equipment and supplies; (c) the arrangement of games and practice time; (4) the ability to obtain coaching and academic tutoring; (d) the provision of locker rooms, practice rooms, and competitive facilities; (e) advertising; and (f) the recruitment of coaching and academic tutoring. Descriptive and causal-comparative methods were used to analyze the data. The findings showed that regardless of their function, athletic directors, head girls coaches, and head boys coaches in Texas public high schools believed their schools complied with Title IX criteria to a high degree. A descriptive examination of the replies by respondent role revealed minor differences between male and female head coaches. Finally, the study revealed athletic directors should pay greater attention to coaching assignments, salary, and athletic facilities to comply with Title IX of the 1972 Education Amendments. Everyone deserves the opportunity to participate and not be discriminated against because of their gender. Title IX's legislation has been in place since 1972 and has affected female participation in a positive form towards gender equity. However many institutions still have difficulty complying with the standards mandated by Title IX. Gender equity is established by meeting substantial proportionality, continued expansion, or full accommodations prongs mandated by Title IX for an institution to be in compliance. The purpose of this study was to determine the perceptions of the athletic directors of the 15 public community and junior colleges in Mississippi regarding Title IX compliance and determine if their respective institutions are in compliance with the substantial proportionality (SP) prong of Title IX. The study identified the perceptions of the athletic directors regarding their institutions' Title IX compliance, as well as the effective strategies and barriers toward meeting the requirements to comply with Title IX within their programs. In addition, the study revealed whether or not the institutions complied with the SP prong of Title IX. Athletic directors (N=15; 53% response rate) from the public community and junior colleges from Mississippi completed the Two-Year College Title IX Survey. Results revealed that overall the athletic directors perceived that their institutions were in compliance with Title IX. However, the athletic directors perceived that the listed strategies were not effective and the barriers listed were not perceived barriers to Title IX compliance. However, the Equity in Athletics Disclosure Act data revealed that none of the institutions complied with the SP prong of Title IX. From a practical perspective, the study revealed that while the athletic directors perceived that their institutions met the SP prong, EADA data revealed that none of the institutions in the state met that prong. Consequently, this finding indicates that there is a need for more education regarding Title IX compliance at the institutions. This information could serve as a starting point for an in-depth institutional study on Title IX. From a theoretical perspective, the study provided information that gives leaders at the public community and junior colleges in Mississippi a unique look at diversity within their athletic departments.

Book excerpt: According to Title IX of the Education Amendments of 1972, no one shall be discriminated against based on their sex or gender. Over the years, the Office of Civil Rights (OCR) sent out Dear Colleague letters as a way to issue guidance on interpretation of Title IX. Many iterations and guidance documents have been issued over the years since this amendment. On April 4, 2011, the Office of Civil Rights issued a Dear Colleague letter outlining mandates for colleges and universities to assist students with complaints of sexual misconduct. The purpose of this study was to examine Title IX administrator perception of institutional compliance at small, private institutions with regard to the guidelines highlighted in the April 4, 2011 Dear Colleague letter. Secondary to overall perceived compliance, the study aimed to get feedback from these administrators on perceived barriers to compliance and effectiveness of remedies used for cases of sexual misconduct. Findings indicate that Title IX administrators at small, private institutions generally perceive compliance with most regulations outlined in the April 4, 2011 Dear Colleague letter. Statistically significant associations reportedly exist between the compliance topics of investigations, training, and education if the respondent or their respective institution hold membership in a Title IX related organization such as the Association for Student Conduct Administration (ASCA), Association for Title IX Administrators (ATIXA), or the National Center for Higher Education Risk Management (NCHERM). Respondents also reported that the most significant barrier to compliance is the ability to effectively train their administrators annually because national trainers can be costly. In order for Title IX administrators at small, private institutions to increase their perception of compliance, administrators would benefit from membership in one of the Title IX related organizations listed, or a similar organization that can assist campus administrators in keeping up with the changing legislation. This could also assist administrators in collectively working to provide training for coordinators, adjudicators, and investigators by learning from colleagues and finding additional ways to accomplish these areas of compliance while keeping costs down.
