L'utilité et la pauvreté monétaire sont des critères de bien-être insuffisants: les théories de la justice de RA WLS et SEN montrent qu'il faut prendre en compte les libertés, les droits et les opportunités offertes aux individus. Un nouveau cadre normatif est proposé pour la définition des politiques d'action sociale : l'Etat doit établir et mettre en œuvre les principes de justice; les services sociaux doivent permettre à tous de participer à la coopération sociale. Pour y parvenir, ces politiques doivent tenir compte de la vulnérabilité de certaines personnes, qui invalide les hypothèses de rationalité et de souveraineté du consommateur. Sont ainsi soulevées les questions : des fondements de ces politiques et des modalités d'identification des besoins ; des principes de justice sociale qui fondent les mécanismes de solidarité; du type de services à développer et de la nature de leurs opérateurs. L'importance du rôle économique du tiers secteur est soulignée à partir d'une comparaison internationale : prestataire de services, il contribue aussi par sa "fonction tribunitienne" à l'élaboration des politiques d'action sociale, ce qui n'est pas sans influence sur leurs formes.
