Book excerpt: Excerpt from Report of the Special Committee on State Prison: Submitted March 29, 1855 The convicts at the Prison are engaged in making brick, on grounds adjoining the Prison grounds, which are well adapted for the purpose, and under the control of General Estell. 't hose at Marin Island are engaged at quarrying stone from an excellent quarry, which we understand is owned by General Estell. The Committee having ascertained the present market value of brick and stone in the city of San Francisco, and the quality that can be furnished by convict labor, are well satisfied that, with ordinary energy and judgment, the institution can be made not only a self-supporting institution, but even profitable. Yet the Committee are assured by the lessee that he has lost, by keeping the State pris oners, under his present contract, These losses, he informs us, occurred in consequence of bad management in the Prison matters, and that only in the last six months has he been able to make any profit on the Prison labor. He has now favorable contracts for furnishing bricks and stone, -in the city of San Francisco, and that he has realized profit in the last six months. From evidence, your Committee believe that, with ordinary care, a profit of one dollar per day to the convict may be realized, over and above all necessary expenses, such as food, clothing, guards, and working tools. Estimating the number of working convicts at three hundred, we have, by this calculation, per week, or clear profit per year. This calculation is made upon the supposition that favorable contracts can be made for the delivery of bricks and stone in the city of San Francisco, or at a place no further from the Prison. Book excerpt: Excerpt from Report of the Industrial Commission on Prison Labor, Vol. 3: Prepared in Conformity With Act of Congress Approved June 18, 1898 To the Senate and House of Representatives, Fifty-sixth Congress: The Industrial Commission established by act of Congress of June 18, 1898, have the honor to submit this report of the results of our investigations into the employment of the inmates of the penal, reformatory, and eleemosynary institutions of the different States and Territories, and the competition of such labor with free labor. The sections of the law creating the commission under which we have acted in the preparation of this report are as follows: "Sec. 2. That it shall be the duty of this commission to investigate questions pertaining to immigration, to labor, to agriculture, and manufacturing, and to business, and to report to Congress and to suggest such legislation as it may deem best on these subjects. "Sec. 3. That it shall furnish such information and suggest such laws as may be made a basis for uniform legislation by the various States of the Union, in order to harmonize conflicting interests and to be equitable to the laborer, the employer, the producer, and the consumer." The investigation of the employment of the prison population has extended into all of the States and Territories. The systems under which prisoners are employed and the conditions of such employment prevailing in each State are presented with recommendations for such changes as are considered necessary to improve the conditions and lessen the competition with free labor. The opinions and recommendations of the various committees, commissions, bureaus, and specialists who have investigated and reported on the subject of prison labor have been consulted and their conclusions in regard to the desirable and undesirable features of the different systems of employment are presented. From these sources the commission draws certain conclusions. In addition, testimony taken before this commission, and which will mainly appear in a forthcoming volume on Manufactures and General Business, sustains the suggestions for legislation herein made. Idaho has an indeterminate sentence law, with a year for the minimum for almost all crimes. After serving the minimum period a parole may be granted at any time. In Illinois, misdemeanants may be committed to and paroled from the state reformatory. In Iowa, misdemeanants may be committed to and paroled from the state reformatory. In Kansas, the governor has power to parole in any case of crime, from any place of imprisonment, upon condition that application shall be made to the governor and notice of hearing published for thirty days in the official paper of the county from which the prisoner was sentenced. Massachusetts has special parole rulings for the state farm, prison camp, and hospital. In Michigan, misdemeanants may be committed to and paroled from the state reformatory. In New Jersey, misdemeanants may be committed to and paroled from the state reformatory. In New York, misdemeanant females, between the ages of six teen and thirty, may be committed to and paroled from the state reformatory for women at Bedford or the Western House of Refuge at Albion. The Elmira Reformatory receives male prisoners committed the second time for a misdemeanor with a maximum term of three years and Opportunity for parole after serving about thirteen months.
