La persistance de la pauvreté est un défi majeur pour une application effective des instruments juridiques des droits de l'homme. Elle nous invite à une réflexion globale sur les droits et leur interprétation, leur effectivité et leur exigibilité. Les pauvres se trouvent démunis juridiquement pour faire valoir leurs droits, d'une part faute d'inclusion de la problématique de pauvreté dans le champ d'application des droits justiciables, d'autre part faute de justiciabilité de certains droits. Par ailleurs, la volonté de venir à bout du problème de la pauvreté s'est souvent exprimée au travers d'instruments à caractère déclaratoire, sans valeur contraignante. La situation globale de nombreux pays pauvres nous incite également à appréhender la pauvreté dans sa dimension collective. La problématique de la pauvreté a été absorbée par le concept de développement dont le droit international du développement en est la traduction juridique. Aujourd'hui, si l'on met davantage en exergue le fait que chaque pays est responsable au premier chef de son propre développement économique et social, les recours à l'aide publique au développement et à l'allègement de la dette sont toujours nécessaires. Les pays pauvres ont besoin d'assistance pour le renforcement de leurs capacités nationales. Il est clair qu'en ce début du 21éme siècle existe la volonté d'intégrer l'impératif de lutte contre la pauvreté dans toutes les actions et politiques internationales, y compris en matière commerciale. Le recul de la pauvreté dépend de l'effectivité des droits et des politiques.
