Di ciò era consapevole anche il Costituente, che volle dedicare particolare attenzione al fenomeno culturale nel suo complesso, prevedendo al contempo la tutela e la promozione della cultura, come anche della ricerca (art. 9), nonché la protezione della libertà dell’arte, della scienza e del loro insegnamento (art. 33). Dalla lettura delle disposizioni costituzionali è possibile ritenere che il patrimonio culturale realizzi compiutamente il valore unitario della Nazione, identificando la “cultura italiana” attraverso i beni e le tradizioni storiche e sociali. I profili organizzativi assumono fondamentale rilievo perché non solo debbono garantire la tutela e la valorizzazione del patrimonio culturale ma anche la sua trasmissione e conservazione nell’interesse delle future generazioni. Funzioni che sono oggi svolte sia tramite le istituzioni pubbliche (anche con strumenti di cooperazione valorizzati dal principio di sussidiarietà “verticale”) sia attraverso il coinvolgimento a vario titolo dei privati. A tal proposito, il Codice dei beni culturali e del paesaggio del 2004 ed il Codice dei contratti pubblici del 2016 accordano un ruolo rilevante ai privati, nella valorizzazione del patrimonio culturale, con varie tipologie di accordi e forme di partenariato.

This research was based on the transfer of knowledge from members of the Albanian Diaspora in Italy (university students, young architects and researchers) to their home country. This unique process blazed a trail in the Albania-related studies by creating a methodology, which could be replicated not only in Albanian rural contexts, but also elsewhere. The book constitutes a structured tool for generating sustainable and socially inclusive territorial development processes in five lesser-known Albanian cultural sites. Their tangible and intangible cultural heritage was seen as a driving factor for triggering development processes aimed at improving the inhabitants’ quality of life and strengthening local identity and social networks. On the one hand, its increasing importance is closely linked to institutional reforms that strengthened the European Court of Human Rights' reputation vis-a-vis the Member States. On the other hand, and even more importantly, the ECHR's significance arises from a changing perception of its constitutional potential. Starting with the assumption that the ECHR is transforming the European constitutional landscape, this book shows that the European Convention raises unprecedented problems that involve, first of all, its own theoretical status as constitutional instrument that ensures the protection of human rights in Europe. Changing paradigms concerning its incorporation in domestic law, as well as the growing conflicts about the protection of some rights and liberties that are deeply rooted in national legal contexts (such as teaching of religion, bio law, and rights of political minorities), are jointly examined in order to offer a unified methodology for the study of European constitutional law centered upon human rights. For a detailed analysis of these issues, the book examines the different facets of the ECHR's constitutional relevance by separating the ECHR's role as a 'factor of Europeanization' for national constitutional systems (Part I) from its role as a veritable European transnational constitution in the field of human rights (Part II). Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition. Indeed, populism frequently relies on concepts and categories belonging to the language of constitutionalism (majority, democracy, people), offering a kind of constitutional counter-narrative.

Of course, it will not be possible to argue for every single part of a philosophical building: to do so would mean to embark in a virtually endless enterprise. Accordingly, some of the parts of a philosophical building will have to be taken from the literature on the subject as 'ready made' or 'semi-finished' elements, while others will be argued for in the course of building. This is what happened in my work too. In some cases (for in stance, in the case of epistemic relativism), my concern was to illustrate theses which I believed to be sufficiently consolidated, rather than to ar gue for them. In other cases - where I was directly engaged in building the theory that I want to fonnulate - I did exactly the opposite. This is what I have tried to achieve, for example, for those proper architraves of my construction, viz. the connection between scepticism and metaphysi cal realism. and the thesis of the nonnative value of the fundamental epistemological notions (truth, objectivity, and rationality).

During his confinement for his anti-fascist beliefs, the Italian political philosopher Carlo Rosselli (1899-1937) wrote this work not only as a critique of fascism, but also as an investigation into the history of Marxism and the need for a liberal reformulation of socialism. In this first English- language edition, Nadia Urbinati highlights both the historical and theoretical importance of Liberal Socialism, which continued to inspire the anti-fascist movement "Giustizia e Liberta." long after Rosselli's assassination by Mussolini's agents, and which outlines a possible rebirth of the socialist and democratic movements. Rosselli's analysis provides an illuminating interpretation of the ideological crisis of Marxism, in its positivistic version, during the late nineteenth century and exposes the intellectual weakness of revisionist efforts to delineate new versions of Marx's doctrine. He encourages readers to view socialism as an ethical ideal and to consider whether Marxist or liberal methods combine better with socialism to achieve that ideal. Rosselli opts for a liberal socialism that avoids the shortcomings of uncontrolled laissez-faire but favors state intervention to secure public services and social rights.
