Book excerpt: Excerpt from Practice Before the Comptroller of Patents Comptroller-General of Patents' report for the year 1910 shews that in the year 1909-1910 there were 30,603 applications for patents, and 2,829 applications for patents under the International Convention. In the same year there were 1, 005 hearings to meet Office objections to acceptance; and also 4,511 hearings in opposition, revocation, amendment, and other cases fixed, of which 2,320 were heard. It is apparent, therefore, that there is a very large practice at the Patent Office and before the Comptroller. Information on the details of and precedents for this practice have had hitherto to be sought in official documents and works treating generally of patent law, which latter are to a great extent necessarily occupied with the action for Infringement and other actions in the High Court. It was therefore thought that a book which dealt in detail and completely with this practice only would be useful. This book is written with the object of fulfilling this want, and it is intended in it to treat of Patent Office practice exclusively and in greater detail than has before been done. To this end all the reported cases which have come before the Comptroller or Law Officer since 1883 are discussed in the following pages, save a small number which were found to be entirely unimportant. In accordance with this delegation of power, Congress has enacted laws giving to authors and inventors the exclusive control of their writings and discoveries. This exclusive control is not given to them because an inventor has any moral right to prevent others from enjoying the fruits of his new ideas, but because it was recognized that, by giving him the exclusive control of his invention for a short period, the arts would be encouraged, the public would obtain the right to enjoy the invention after that period, and the prosperity of the country would be increased thereby. That these results have been accomplished is evident. Morse would probably not have struggled to produce the telegraph, nor Eli Whitney to produce the cotton gin, Goodyear would not have gone through years of abject poverty in order to accomplish the successful vulcanization of rubber, Edison would probably not have given to the world the incandescent electric light, nor Bell the tele phone, without the hope of a reward, - and these are only a few of the many inventions which have been the result of years of experiment and which have made this country the manufacturing center of the world. This reward is not, however, given to the inventor for his mere production of the new thing. The Govern ment enters into a contract with him, and gives him a patent in consideration of his disclosing the invention inhis patent in such full, clear, concise, and exact terms as to enable any person skilled in the art or science to which it appertains or with which it is most nearly connected, to make, construct, compound and use the same, to the end that the public may be able, at the expiration of the limited time, to reproduce and enjoy the invention. Without inventors it would be necessary to imagine an entirely different world, in its productive resources, from that in which we live at present. Without them the development of man's muscular power would still be the principal aim of those who desired to have their country solidly established and capable of com peting with other nations, as was the case in earlier times, when scientific methods and machinery were of only second ary importance; for their great value was not known, and the strong man in more esteem on account of his mere physical strength.
