Book excerpt: Infrastructural investment is critical to economic growth, quality of life, poverty reduction, access to education, health care, and the achievement of many of the goals of a robust economy. But infrastructure is difficult for the public sector to get right. Public–private partnerships (PPPs) can help; they can provide more efficient procurement, focus on consumer satisfaction and lifecycle maintenance, and provide new sources of investment, in particular through limited recourse debt. But PPPs present challenges of their own. This book provides a practical guide to PPPs for policy makers and strategists, showing how governments can enable and encourage PPPs; providing a step-by-step analysis of the development of PPP projects; and explaining how financing works, what contractual structures look like, and how risk allocation works in practice. It includes specific discussion of each infrastructure sector, with a focus on the strategic and policy issues essential for successful development of infrastructure through PPPs. This second edition includes new sections on institutional frameworks, mechanisms for leveraging public financing, small scale PPP projects and more.

Book excerpt: Risk Pricing Strategies for Public-Private Partnership Projects Innovation in the Built Environment The complexity of public–private partnership (PPP) project procurement requires an effective process for pricing, managing and appropriate allocation of risks. The level at which risk is priced and the magnitude of risks transferred to the private sector will have a significant impact on the cost of the PPP deals as well as on the value for money analysis and on the selection of the optimum investment options. The construction industry tends to concentrate on the effectiveness of risk management strategies and to some extent ignores the price of risk and its impact on whole life cost of building assets. There is a pressing need for a universal framework for the determination of fair value of risks throughout the PPP procurement processes. Risk Pricing Strategies for Public–Private Partnership Projects addresses the issues of risk pricing and demonstrates the use of a coherent strategy to arrive at a fair risk price. The focus of the book is on providing risk pricing strategies to maximise return on risk retention and allocation in the procurement of PPP projects. With its up-to-date coverage of the latest developments in risk pricing, and comprehensive treatment of the methodologies involved in designing and building risk pricing strategies, the book offers a simple model for pricing risks. The book follows a thematic structure: PPP processes map; risk, uncertainty and bias; risk pricing management strategies; risk pricing measurement and modelling; risk pricing at each of the project life-cycle stages – and deals with all the important risk pricing issues, using relevant real-world situations through case study examples. It explains how the theory and strategies of risk pricing can be successfully applied to real PPP projects and reflects the broad understanding required by today’s project risk analysts, in their new and important role in PPP contract management. Book excerpt: This publication presents a detailed overview of the current state of the public–private partnership (PPP) environment in the Philippines. In over three decades, the country developed a robust public–private partnership (PPP) enabling framework through the Build-Operate-Transfer Law of 2012 and the PPP Center. Among developing member countries of the Asian Development Bank, the Philippines has a relatively mature market that has witnessed 116 financially closed PPPs. Under the government’s 2017–2022 Development Plan that has an infrastructure investment target of $180 billion, PPPs are expected to play a pivotal role in financing national and subnational infrastructure investments. With a pipeline of 37 PPPs, the government is taking various steps to further improve the environment for PPPs.

From 1990 to 2019, Pakistan witnessed 108 financially closed PPP projects, with a total investment of approximately $28.4 billion. About 88% of these projects are in the energy sector, attracting more than $24.7billion, followed by investments in the port sector. In early 2021, Parliament approved the amendments to the 2017 PPP Law, enacting the Public Private Partnership Authority (Amendment) Act 2021. This further strengthens the enabling legal and regulatory framework for developing and implementing PPPs, thereby promoting private sector investment in public infrastructure and related services.

Book excerpt: The Government of Kazakhstan considers public-private partnership (PPP) as an important source of infrastructure funding and service delivery; thus, it continues to improve the legal mechanisms of PPP, develop its institutional setup, and structure pilot projects. PPP has been employed at the central and local government levels to deliver economic and social infrastructure including education, healthcare, transport, power, housing, and public utilities. However, many of these projects are small-scale and short-term. Kazakhstan has adopted the Law on Concessions defining the concept of PPP and a separate PPP Law. The government has established a two-tier institutional structure to support the deployment of PPPs—on the national and the regional level. The most prominent of them are the PPP Center, acting as the adviser to the government, Turar Healthcare and Financial Center, assisting with project development.

Book excerpt: Many coastal fisheries are poorly managed and overexploited, resulting in suboptimal yields and lost revenue, and damage to other species and habitats. The Coastal Fisheries Initiative (CFI) is a global effort between FAO and other development partners to address these issues in a holistic and integrated way. It aims to work at a practical level with selected fisheries and to facilitate a global exchange of experience and learning. The CFI comprises subsidiary regional projects in Indonesia, Latin America and West Africa, a sustainable investment support project, and a global partnership and coordination project. The mid-term evaluation of the global coordination project found that, while the initiative is extremely relevant, it has so far had limited impact of a strengthened global partnership. The evaluation recommended greater coordination between the subsidiary projects, a strengthened reporting structure and a project extension of up to two years.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive overview of the law surrounding PPPs in the Middle East and North African region. The significance of liberalised and integrated Public Private Partnership Contracts as an essential component of the world legal and policy order is well documented. The regulation of PPPs is justified economically to allow for competition in the relevant public service and to achieve price transparency, thus resulting in significant savings for the public sector. In parallel to the economic justifications, legal imperatives have also called for the regulation of PPPs in order to allow free movement of goods and services and to prohibit discrimination on grounds of nationality. The need for competitiveness and transparency in delivering public services through PPPs is considered a safeguard to achieve international standards in delivering public utility services. First, it assesses the compatibility of the current PPPs legislation and regulation in the MENA region with the international standards of legislation and regulation prevalent in many other countries, including the UK, France and Brazil. Secondly, it compares the practices in the MENA region with those of international bodies such as the OECD and World Bank. Comparisons are then made between the MENA countries and those in Europe and Asia with regard to the influence of culture, policy and legal globalization. The book will be of interest to scholars and students in the field of international contract law, public law and state contracts, finance law and private law.

Designed as a one-stop source of information on Bangladesh’s relatively mature PPP sector, it assesses over 500 qualitative and quantitative indicators, and shows how strengthening institutional frameworks has encouraged investments in core sectors such as ports, energy, and transportation. It explores how Bangladesh now needs to ramp up regulation and tighten contractual frameworks to generate more\ long-term financing and fill the funding gap it faces as demand for climate-resilient infrastructure rises.
