For centuries, courts insisted on strict compliance with these fussy statutory requirements. But in 1975, South Australia adopted the harmless error rule, which permits judges to forgive execution defects if there is compelling evidence that a decedent intended a document to be effective. Although several countries have now embraced this powerful curative doctrine, most American states have not. This root of this resistance is fear that replacing the clean lines of traditional law with a muddy standard will breed litigation. This invited contribution to the Iowa Law Review's Wealth Transfer Law in Comparative and International Perspective Symposium updates our understanding of the harmless error rule by offering the first study of its impact on the day-to-day operations of a U.S. probate court. Its centerpiece is a dataset of 2,453 estates that came on calendar in Alameda County, California between 2008 and 2010. The Golden State adopted what I call “partial” harmless error -- a statute that can cure some deviations from the Wills Act but not others -- in 2009. Thus, my research offers new insight into the costs and benefits of relaxing the formalities that govern the execution of wills. My marquee finding is that partial harmless error's impact on the litigation rate was minimal. In addition, I show that by retaining certain statutory elements as mandatory, partial harmless error prevents migraine-inducing dilemmas about whether a decedent wanted an instrument to be her will.

The conventional wisdom is that historically courts have insisted on absolute strict compliance, favoring formalities over testamentary intent. In 1975, Prof. John Langbein argued that substantial compliance with the Wills Act formalities should suffice. A little over a decade later, he modified his proposal, arguing for a harmless error approach.Prof. Langbein's proposals have been well received. Many academics have endorsed them. The Uniform Probate Code and the Restatement (Third) of Property have adopted his harmless error approach. Yet relatively few states have adopted either proposal. If Prof. Langbein's substantial compliance/harmless error proposals are so much better than strict compliance, what explains the failure of most jurisdictions to adopt either of them?This Article argues that (1) many of the states intuitively realize that the issue is not as simple as Prof. Langbein depicts it - that 'strict compliance' is neither as monolithic nor as strict as he portrays it; (2) most jurisdictions, in fact, do not apply the strict compliance approach he describes but rather a variation of it - flexible strict compliance; and (3) the real issue is not whether substantial compliance/harmless error is better than traditional strict compliance, but whether substantial compliance/harmless error is better than flexible strict compliance - and the answer to that question is far from obvious. Flexible strict compliance adopts a more pragmatic approach to the public policy considerations underlying the Wills Act formalities, eschewing the functional approach and instead favoring an approach that balances testator's intent with costs of administration and the potential for fraud, resulting in an approach that is more efficient than either substantial compliance or harmless error.

Book excerpt: In Irresolute Testators, Clear and Convincing Wills Law, Professor Jane Baron draws attention to a conflict between the mechanics of the law of wills and the realities of testation. Baron observes that the law of wills is designed to be used as a tool by resolute and rationale testators to communicate their intent regarding the distribution of property upon death. However, the law's archetypical testator does not represent the many real testators who are irresolute and irrational, those possessing incoherent and only partially formed thoughts regarding the disposition of their estates. Based upon the disconnect between the law's paradigm of resolute will-making and the irresoluteness of testation in the real world, Baron argues that reforms that have given probate courts discretion to correct mistakes in testation do not function appropriately. For instance, Baron argues that the harmless error rule, which allows courts to excuse defects in a testator's compliance with will-execution formalities when the testator's intent is established by clear and convincing evidence, does not meaningfully limit probate courts' discretion to correct mistakes. Specifically, she argues that many courts are concerned with not only the technical mistakes of resolute testators but also the more troubling mistakes of irresolute testators, and consequently, these courts overreach the boundaries of the harmless error rule. This essay acknowledges Baron's insight regarding the tension between the law and reality but questions whether this tension renders the harmless error rule and its clear and convincing evidence standard ineffective. More particularly, this essay argues that, despite potential overreaching by some courts, the clear and convincing evidence standard likely operates in the way that reformers intended and that the harmless error rule represents an improvement upon the conventional law of will- execution.

Book excerpt: We think of an unsigned “will” as an oxymoron. Since 1837, the Wills Act has required testators in Anglo-American legal systems to memorialize their last wishes in a signed writing. But recently, several American states have adopted an Australian innovation called harmless error, which validates a botched attempt to make a will if there is strong evidence that a testator intended it to be valid. Thus, in these jurisdictions, the testator's signature is no longer mandatory. Meanwhile, decedents have started making wills in formats that do not permit “wet” signatures, such as e-mails, text messages and word processing files. These trends raise the same question: when, if ever, can a testator assent to a will through her words or conduct? This Article explores the topic of wills with missing or unorthodox signatures. It begins by analyzing a neglected body of precedent on point that spans centuries and countries. First, before the Wills Act, testators could bequeath personal property in unsigned writings. Accordingly, ecclesiastical courts in England and early American judges routinely decided whether a decedent had approved of an unexecuted dispositive instrument. Second, and more recently, dozens of Australian courts have considered whether to apply harmless error to unsigned and electronic wills. These cases, which have reached wildly different conclusions, vividly illustrate the costs and benefits of relaxing the signature requirement. The Article then draws insights from the unsigned will jurisprudence to propose a partial exception to the signature mandate. Traditional law treats the absence of a signature as conclusive proof that a decedent lost her nerve or changed her mind. However, the unsigned will cases reveal that the true culprit is often the fact that a person passed away or lost mental capacity shortly before she could put pen to paper. Accordingly, under what the Article calls the “momentum theory,” courts should enforce written expressions of dispositive wishes when there is clear and convincing evidence that a testator was on the verge of executing a will that memorialized them. This safe harbor for testators whose estate planning efforts were interrupted by forces outside of their control would improve outcomes in several common (or soon-to-be common) kinds of disputes, including those involving notes for future wills, drafts that the testator never read, and digital documents.

The Israeli rule has been persistently misunderstood in the English language literature. The article reports the author's examination of the original Hebrew language sources. Despite the claim of American reformers that Israel possessed a successful harmless error rule, the Israeli will execution statute was construed by the courts to require strict compliance with certain will execution formalities. Recently, the Israeli will execution statute has been amended. The statute now requires strict compliance with the requirements that a proffered document be in writing and that it is presented by the testator as a will to two witnesses. All other will execution flaws can be cured if a court has “no doubt” that a proffered document was intended by the testator to be a will. A survey of the case law applying the new statute indicates that this rule, which amounts to a harmless error rule with threshold requirements, will generally protect the authentic testamentary intent of testators. American reformers who are frustrated with strict compliance with Wills Act formalities but fear the possible abuses of a harmless error rule can use the current Israeli statute as a model.
