Book excerpt: In this report, "Care and compassion?" the Health Service Ombudsman says the NHS is failing to treat older people with care, compassion, dignity and respect. The report is based on the findings of ten independent investigations into complaints about NHS care for people over the age of 65 across England. It serves to illuminate the gulf between the principles and values of the NHS Constitution and the felt reality of being an older person in the care of the NHS in England. The Ombudsman's findings show how ten older patients suffered unnecessary pain, indignity and distress while in the care of the NHS. Her investigations highlight common failures in pain control, discharge arrangements, communication with patients and their relatives and ensuring adequate nutrition. These are not isolated cases. Of the nearly 9,000 properly made complaints to the Ombudsman about the NHS last year, 18 per cent were about the care of older people. The Ombudsman accepted twice as many cases for investigation about older people as for all other age groups put together. The findings reveal an attitude - both personal and institutional - which fails to recognise the humanity and individuality of the people concerned and to respond to them with sensitivity, compassion and professionalism. These accounts present a picture of NHS provision that is failing to meet even the most basic standards of care. The NHS must close the gap between the promise of care and compassion outlined in its Constitution and the injustice that many older people experience.

The new system, which affects about six million families, is aimed at helping tackle child poverty and encouraging more people into work. The report considers the background to the introduction of the new system; design and delivery aspects; processing errors; communication and accessibility; overpayments; complaints and appeals; and wider tax credits issues. Although the project has been broadly successful given its scale of undertaking, the report focuses on cases of financial hardship caused as a result of the recovery of overpayments of tax credits, particularly for families on low incomes, the core group which the system is aimed at helping. Two key problems are highlighted relating to i) the system's design, based on annual awards with a degree of inbuilt financial uncertainty; and ii) its delivery, using a processing system that is wholly IT-based. The report makes 12 recommendations for actions to improve overpayment recovery processes, complaint handing and Revenue communications with customers, and to highlight key lessons that can be learned across government in the implementation of new policies and systems.

The slow but steady growth in the protection of imprisoned people’s rights over recent decades in Australia has mostly come from incremental change to prison legislation and common law principles. A radical influence is about to disrupt this slow change. Australian prisons and other closed environments will soon be subject to international inspections by the United Nations Subcommittee on the Prevention of Torture (SPT). This is because the Australian Government ratified the Optional Protocol to the Convention Against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT) in December 2017. Australia’s international human rights law obligations as they apply to prisons are complex and stem from multiple Treaties. This book distils these obligations into five prerequisites for compliance, consistent with the preventive focus of the OPCAT. They are: reduce reliance on imprisonment align domestic legislation with Australia’s international human rights law obligations shift the focus of imprisonment to the goal of rehabilitation and restoration support prison staff to treat imprisoned people in a human rights–consistent manner ensure decent physical conditions in all prisons. Attention to each of these five areas will help all levels of Australian government and prison managers take the steps required to move towards compliance. Human-rights led prison reform is necessary both to improve the lives of imprisoned people and for Australia to achieve compliance with the international human rights legal obligations to which it has voluntarily committed itself.
