Book excerpt: O enquadramento de corpos d'água é um instrumento legal do arcabouço da legislação ambiental brasileira contemplado na Política Nacional de Recursos Hídricos, que faz parte da Lei 9.433/97. Sua regulamentação está contida nesta mesma lei, bem como em outros instrumentos jurídicos, como a Resolução CONAMA 357/05, no âmbito federal, e legislações estaduais que tratam sobre o tema da água. A presente dissertação usou três diferentes metodologias para obter atingir o objetivo proposto de estudar o enquadramento participativo de corpos d'água como instrumento de gestão da água, com aplicação na bacia hidrográfica do Rio Cubatão Sul. Uma das metodologias escolhidas foi a revisão bibliográfica que versa nesse trabalho sobre os temas: do enquadramento de corpos hídricos, dos recursos hídricos, da participação, dos direitos difusos e princípios do direito ambiental e ainda das tecnologias sociais na busca de um enquadramento de corpos d'água mais consciente. A segunda metodologia, a pesquisa documental, se ateve a buscar dados sobre a realidade e o estado do enquadramento dos corpos d'água no Brasil e no Mundo, tendo como resultado um panorama. Houve com esta pesquisa a identificação de elementos metodológicos nas experiências brasileiras de enquadramento, que resultou na montagem de um roteiro metodológico para o enquadramento participativo de corpos d'água o ROMEP. A terceira metodologia, empírica e participativa: a pesquisa-ação (THIOLLENT), foi aplicada junto ao grupo de trabalho do Comitê de Bacia do Rio Cubatão Sul, bem como a exposição do ROMEP o que culminou, portanto, na montagem de um roteiro metodológico para o enquadramento dos corpos d'água da bacia hidrográfica do Rio Cubatão Sul o ROMEPBHCS. Este roteiro metodológico pode ser considerado uma tecnologia social, pois é o resultado de uma mobilização social no intuito de solucionar demandas sociais concretas identificadas pela população. Este resultado cumpre com os objetivos da tecnologia social que são de promover o empoderamento da população, a troca de conhecimento entre os atores envolvidos nos processos, a transformação no modo de as pessoas se relacionarem com alguma demanda ou questão social, neste caso específico: os objetivos e metas de qualidade da água, a inovação a partir da participação e o desenvolvimento de instrumentos para realização de diagnósticos e avaliações participativas, neste caso o ROMEPBHCS.

This problem is made even more severe by human actions that can cause degradation to nature and the environment. The availability of clean and inexpensive water can no longer be taken for granted as the need for water continues to increase due a growing global population. Heavy water consumers such as agriculture and industry often contribute to its contamination. Water distribution networks in urban areas and soiled water collection systems, present serious problems as well as the need to maintain ageing infrastructures. Possible technologically solutions, such as desalination or pumping systems are energy demanding but, as costs rise, the techniques currently developed may need to be re-assessed.
