But GAO found that these offices do not systematically align ATA assistance with U.S. assessments of foreign partner counterterrorism needs nor to they consistently use country-specific needs assessments and program reviews to plan assistance. GAO suggests that Congress reconsider the requirement that State prepare an annual report on U.S. counterterrorism assistance and that State review its ATA program guidance, its use of needs assessments, and measures for assessing the ATA program.

In fiscal years 2012 through 2016, State allocated about $715 million to the ATA program, which it reports to have used to train about 56,000 security force officials from more than 34 partner nations. At least 2,700 of those participants were trained at facilities in the United States. GAO was asked to review ATA program management. This report examines, among other objectives, (1) State's ability to oversee ATA participants trained in the United States and (2) the steps State has taken to ensure that facilities used for domestic ATA training align with applicable security requirements. GAO conducted fieldwork at two domestic training facilities selected because they provide tactical training; analyzed State and DHS data and documentation related to fiscal year 2012 through 2016 domestic training participants; and interviewed State and DHS officials, including those who oversee ATA training for three partner nations receiving significant ATA training. Book excerpt: All U.S. agencies with counterterrorism programs that collect or "mine" personal data-such as phone records or Web sites visited-should be required to evaluate the programs' effectiveness, lawfulness, and impacts on privacy. A framework is offered that agencies can use to evaluate such information-based programs, both classified and unclassified. The book urges Congress to re-examine existing privacy law to assess how privacy can be protected in current and future programs and recommends that any individuals harmed by violations of privacy be given a meaningful form of redress. Two specific technologies are examined: data mining and behavioral surveillance. Regarding data mining, the book concludes that although these methods have been useful in the private sector for spotting consumer fraud, they are less helpful for counterterrorism because so little is known about what patterns indicate terrorist activity. Regarding behavioral surveillance in a counterterrorist context, the book concludes that although research and development on certain aspects of this topic are warranted, there is no scientific consensus on whether these techniques are ready for operational use at all in counterterrorism.
