Book excerpt: In 1965, the UK excised the Chagos Islands from the colony of Mauritius to create the British Indian Ocean Territory (BIOT) in connection with the founding of a US military facility on the island of Diego Garcia. Consequently, the inhabitants of the Chagos Islands were secretly exiled to Mauritius, where they became chronically impoverished. This book considers the resonance of international law for the Chagos Islanders. It advances the argument that BIOT constitutes a 'Non-Self-Governing Territory' pursuant to the provisions of Chapter XI of the UN Charter and for the wider purposes of international law. In addition, the book explores the extent to which the right of self-determination, indigenous land rights and a range of obligations contained in applicable human rights treaties could support the Chagossian right to return to BIOT. However, the rights of the Chagos Islanders are premised on the assumption that the UK possesses a valid sovereignty claim over BIOT. The evidence suggests that this claim is questionable and it is disputed by Mauritius. Consequently, the Mauritian claim threatens to compromise the entitlements of the Chagos Islanders in respect of BIOT as a matter of international law. This book illustrates the ongoing problems arising from international law's endorsement of the territorial integrity of colonial units for the purpose of decolonisation at the expense of the countervailing claims of colonial self-determination by non-European peoples that inhabited the same colonial unit. The book uses the competing claims to the Chagos Islands to demonstrate the need for a more nuanced approach to the resolution of sovereignty disputes resulting from the legacy of European colonialism.

Jewish political and cultural behaviour during the first half of the twentieth century comes to the fore in this portrayal of a forgotten movement with contemporary relevance. Commencing with the Zionist rejection of the Uganda proposal in 1905, the Jewish Territorialist Movement searched for areas outside Palestine in which to create settlements of Jews. This study analyses the Territorialists’ ideology and activities in the Jewish context of the time, but their thought and discourse also reflect geopolitical concerns that still have resonance today in debates about colonialist attitudes to peoplehood, territory, and space. As the colonial world order rapidly changed after 1945, the Territorialists did not abandon their aspirations in overseas lands. Instead, in their attempts to find settlement solutions for Europe’s ‘surplus’ Jews, they moved from negotiating predominantly with the European colonizers to negotiating also with the ever more powerful non-Western leaders of decolonizing nations. This book reconstructs the rich history of the activities and changing ideologies of Jewish Territorialism, represented by Israel Zangwill’s Jewish Territorial Organisation (the ITO) and, later, by the Freeland League for Jewish Colonization under the leadership of Isaac Steinberg. Via Uganda, Angola, Madagascar, Australia, and Suriname, this story eventually leads us to questions about yidishkeyt, and to forgotten early twentieth-century ideas of how to be Jewish.

While this volume considers their role as financial centres, it does so from alternative and original perspectives by examining how the sector shapes the internal dynamics of these Caribbean societies, and how it is itself shaped by global trends. Political relations between the territories and their metropolitan centres and with the European Union are the focus of several chapters, highlighting the stresses and strains, and in many cases the unfulfilled expectations of devolved governance. Finally, several chapters reflect more specifically on the territories’ internal social and ethnic dynamics, and the hierarchies and inequalities that result. Book excerpt: This book considers the ability of island jurisdictions with financial centres to meet the expectations of the international community in addressing the threats posed to themselves and others by their innocent (or otherwise) facilitation of the receipt of suspect wealth. In the global financial architecture, British Overseas Territories are of material significance. Through their inalienable right to self-determination, many developed offshore financial centres to achieve sustainable economic development. Focusing on Bermuda, Turks and Caicos, and Anguilla, the book concerns suspect wealth emanating from financial crimes including corruption, money laundering and tax evasion, as well as controversial conduct like tax avoidance. This work considers the viability of international standards on suspect wealth in the context of the territories, how willing or able they are to comply with them, and how their financial centres can better prevent receipt of suspect wealth. While universalism is desirable in the modern approach to tackling suspect wealth, a one-size-fits-all approach is inappropriate for these jurisdictions. On critically evaluating their legislative and regulatory regimes, the book advances that they demonstrate willingness to comply with international standards. However, their abilities and levels of compliance vary. In acknowledging the facilitatively harmful role the territories can play, this work draws upon evidence of implication in transnational financial crime cases. Notwithstanding this, the book questions whether the degree of criticism that these offshore jurisdictions have encountered is warranted in light of apparent willingness to engage in the enactment and administration of internationally accepted laws and cooperate with international institutions.
