States have also initiated water projects to improve social welfare, often with significant impacts on the environment. This book combines close analysis of the legal structures of water rights with consideration of the modes of water management projects to illustrate current water-related problems in terms of practical solutions in a global context.

Book excerpt: Environmental Law for Practitioners is an invaluable, practice-related introduction to environmental law in Germany, written by specialist legal advisers with extensive experience in the practical application of environmental law. This wholly revised second edition takes account of recent developments in rapidly changing environmental legislation and case-law. It is essential reading for foreign investors as well as providing swift, ready access to legal provisions and terms in both German and English. The book comprises an English description of environmental law in Germany and a bilingual compilation of the most important environmental statute texts. After a brief introduction to German environmental law and a short discussion of the legal bases and principles, fundamental aspects of significant interest to foreign investors are examined. The regulation of environmentally relevant activities is explained in a clear, concise way. Responsibility for residual pollution is discussed in detail. The book also provides a clear overview of both environmental private law and environmental criminal law, focussing on new developments relevant to investors and outlining recent trends in environmental litigation. In addition, environmental levies and their practical application as a formative instrument of environmental policy are described. The relationship between environmental law and contract is also explored. Finally, the authors look at environmental management systems and access to environmental information. The bilingual statute texts make vital legislation on the pollution and protection of the environment available to advisers and investors alike.

Book excerpt: Floating architecture is not only an issue for luxurious tourism but with the climatic change the building of floating structures becomes relevant for many areas in the world. In regions with rising sea levels, frequent flooding, or thawing permafrost, floating structures can be a solution to adapt existing settlement areas to these new conditions. The self-sufficient energy and supply systems required for floating settlements can also be used in rural areas with a lot of migration. The collection presents papers of conferences organized by the Faculty of Architecture and Urban Planning at Brandenburg University of Technology Cottbus-Senftenberg (BTU).

Available in PDF, EPUB and Kindle. Book excerpt: Governance of global water resources presents one of the most confounding challenges in contemporary natural resource governance. With considerable government, citizen and financial donor attention devoted to a range of international, transnational and domestic laws and policies aimed at protecting, managing and sustainably using fresh and coastal marine water resources, this book proposes that sustainable water outcomes require a ‘trans-jurisdictional’ approach to water governance. Focusing on the concept of trans-jurisdictional water governance the book diagnoses barriers and identifies pathways to coherent and coordinated institutional arrangements between and across different bodies of laws at local, national, regional and international levels. It includes case studies from the European Union, Australia, New Zealand, South Africa, the United States and Southeast Asia. Leading specialists offer insights into the pretence and the promise of trans-jurisdictional water governance and provide readers, including students, practitioners, policy-makers and academics, with a basis for better analysing, articulating and synthesising standards of good trans-jurisdictional water governance both in theory and in practice.

Book excerpt: New Instruments for Environmental Policy in the EU provides a comprehensive analysis of the debate over new forms of environmental regulation in the European Union. The conclusions draw attention to critical aspects of instrument design, as well as the difficulty of accommodating national policy diversity without contravening EU and international trade rules. Drawing on critical research and practical experience, this book presents a number of recommendations for improving the next generation of environmental policies and explores comparisons between the search for new environmental instruments in the EU and similar regulatory transitions worldwide.

Book excerpt: This volume contains the proceedings of a conference at Freudenberg, Germany, that brought together some forty (environmental) economists from seven European countries and the U.S. in November 1990 to analy:se "Conflicts and Cooperation in Managing Environmental Resources". I should like to thank the Volkswagen-Stiftung whose finan cial support made this conference possible. Additional funding by the Forschungsinstitut fur Geistes-und Sozialwissenschaften at the Universitiit - Gesamthochschule Siegen is also gratefully acknowledged. The papers and formal comments published in this volume emerged from those presented at Freudenberg. Thorough and competent discussions during and after the conference as well as an anonymous reviewing process led to major revisions which im proved the quality of all contributions. I am grateful to the authors for their construc tive collaboration before and during the conference as well as during the editing process. The authors demonstrated convincingly that they are not only able to scrutinise the inefficiencies of non-eooperation in their research work, but that they also succeeded to learn this lesson by avoiding delays of the editing process at the expense of the remain ing players.

Book excerpt: This book is about environmental and climate legal protection in the energy transition. The Paris Agreement has a binding commitment of holding the global temperature increase to 2°C while pursuing efforts to limit it to 1.5°C. To cope with the negative effects of climate changes and mitigate greenhouse gas emissions, one of the primary responses has been the deployment of renewable energy sources, transiting from fossil fuels to sustainable electricity production. However, renewable energy sources can also cause significant environmental impacts. Wind energy, for instance, can impact biodiversity, such as birds and bats, killing them when colliding with turbines and affecting their migration and nesting. This results in conflicts in environmental law. This book questions whether, in the energy transition, the generation of electricity from renewable sources to protect the climate is compatible with the protection of the environment, both interests in environmental law. To address this question, this book follows a legal-environmental perspective and assesses the common problem of solving those internal environmental conflicts in Brazilian and German law to understand and compare whether and how both legal systems solve the conflicts by compatibilizing the protection of the climate with other environmental interests. The legal analysis focuses on land-use planning and environmental licensing, assessing similarities and differences, and evaluating the results, identifying what one country can learn from the other.
