Book excerpt: Excerpt from Offender Rehabilitation Act: Hearing, Ninety-Second Congress, Second Session, Relating to the Nullification of Certain Criminal Records, S. 2732 The subcommittee met, pursuant to notice, at 10 a.m., in room 6202, New Senate Office Building. Senator Quentin N. Burdick presiding. Present: Senator Burdick. Also present: James G. Meeker, staff director, Ronald E. Meredith, minority counsel, and Judith E. Snopek, chief clerk. Senator Burdick. We are here this morning to begin formal consideration of S. 2732, legislation to quiet certain old criminal records which are barriers to the employment of rehabilitated former offenders. Although this is the first hearing we have held on this bill, these hearings are a continuation of work started by this subcommittee last year on the relationship between crime and unemployment, or underemployment. We have accumulated enough evidence to conclude that there is a real relationship and that we must begin to look for answers to some of the problems. We have learned that a disproportionate share of the people who end up in the criminal justice system had already failed in the economic system. We also know that although most former offenders who are released attempt to secure legitimate employment, it is the ones who get and keep jobs who are most likely to stay out of further trouble. This subcommittee has concerned itself with several aspects of crime and employment. In the Federal prison system, a fourth of tho inmates are involved in training classes or industrial work assignments related to jobs on the outside. We have encouraged expansion of these programs. Job training is not the only answer, however, to the employment of former offenders. There are many problems. Some involve desire, some involve personal attitudes, but some of the employment problems of exoffenders are the result of the barriers we have erected that bar legitimate employment. Book excerpt: The Offender Rehabilitation Act 2014 makes a number of changes to the release arrangements, set out in the Criminal Justice Act 2003, for adult offenders serving custodial sentences of less than 12 months and those serving sentences of between 12 months and 2 years. In particular the Act introduces: arrangements for release under licence to offenders serving fixed-term custodial sentences of more than 1 day but less than 12 months; supervision arrangements for offenders released from fixed-term custodial sentences of less than 2 years so that all offenders are supervised in the community for at least 12 months; a new court process and sanctions for breach of supervision requirements for offenders serving fixed-term custodial sentences of less than 2 years; a requirement that offenders sentenced to an extended determinate sentence must have an extension period of supervision of at least 1 year; introduces for offenders released from custody a new drug appointments condition for the licence or supervision period, and expands the existing drug testing requirement for licences to include Class B drugs; a requirement that any juvenile who reaches his or her 18th birthday before being released from the custodial element of a Detention and Training Order (DTO) should spend at least 12 months under supervision in the community; a requirement that contracts or other arrangements made under the Offender Management Act 2007 for the supervision or rehabilitation of offenders must state what provision, if any, is intended to meet the particular needs of female offenders.

Book excerpt: ′Robinson and Crow have achieved the seemingly impossible: a book about rehabilitation that transcends the "medical model", that is original and contemporary yet grounded in a sophisticated history, and most of all that is fun to read. It will become a new classic text in a field that has been crying out for one′ - Professor Shadd Maruna, Queen′s University, Belfast ′In an age where there is much public and political confusion about many criminal justice matters, this book brings considerable clarity to the idea of rehabilitation, its theoretical and historical roots, and contemporary practical application. This is an accessible, lively, and critical account of a concept which is central to the shape of the criminal justice system in pursuance of something that will "work" to reduce reoffending. "Rehabilitation" seems to go in and out of fashion depending on the politics of the day, but the careful and thorough examination of the different contexts in which it operates and competing perspectives on its potential offered here highlights its enduring qualities. This is a fascinating and engaging book by two established and "real world" scholars which will serve students and policy makers alike in the fields of criminal justice and social policy′ - Loraine Gelsthorpe, Reader in Criminology and Criminal Justice, Institute of Criminology, University of Cambridge This comprehensive text explains all the key themes in the development and practice of offender rehabilitation. It explores how the issue fits within its wider social and political contexts, giving an insight into its current and future relevance to criminal justice. The book covers the full range of rehabilitative approaches, exploring how criminal justice responses have been influenced by trends such as the treatment model, ′What Works?′, desistance, risk and public protection, and changes in social policy. It offers the following essential features: " theoretical grounding - providing students with all the essential background they need in order to fully understand the subject " historical context - enabling the reader to see how ideas, policies and practices have developed over time " research focus - introducing the reader to questions about how rehabilitative approaches have been evaluated and debates about ′what works′ for particular groups of offenders, such as sexual offenders and drug misusers " study questions and further reading - giving students the tools both to revise and to expand their knowledge Offender Rehabilitation both advances thinking about the notion of rehabilitation, and ensures that students of crime and justice can keep abreast of the most recent developments in this area.
