Book excerpt: O presente trabalho se dedica ao estudo da origem e formação do sistema unitário de controle jurisdicional dos atos da Administração Pública, que se desenvolve no Brasil, procurando descobrir suas peculiaridades frente à forma clássica própria dos Estados Unidos, que influencia o regime jurídico-político brasileiro no advento da República. Presencia-se, no bojo do mecanismo de freios e contrapesos republicano, o fortalecimento do Poder Judiciário como resultado de um movimento dialético em que, no decorrer do século XIX, a forma judiciária é negada pela jurisdição administrativa imposta pelo Poder Moderador, atribuída ao Tribunal do Tesouro e ao Conselho de Estado. A superação da contradição transforma o Judiciário e lhe confere autonomia para o exercício amplo do controle sobre os atos do Poder Público, realidade já prenunciada no período imperial em razão da forte tradição de juízo fazendário herdada de Portugal por meio da qual não há qualquer óbice ao ajuizamento de ações de fundo pecuniário contra o Estado, visto como Fazenda Pública. Por isso, apesar da influência dos Estados Unidos, o Brasil não adota, com a República, o princípio da indemandabilidade da soberania, caro aos norte-americanos, que desenvolveram seu sistema muito na repressão ao agente público faltoso, típica do common law, com seu arsenal de writs. No Brasil, a pessoa jurídica de direito público, desde cedo, submete-se à verdadeira composição judicial. Em decorrência, ao mesmo tempo em que lentamente se consolida o binômio impenhorabilidade dos bens públicos-sistema de precatórios, se desenvolve, no seio do mecanismo de freios e contrapesos, uma espécie de controle contraposto, fruto da manifestação da função administrativa no processo judicial, constituído por normas processuais específicas (prazo qualificado para defesa da Fazenda Pública, duplo grau obrigatório de jurisdição, suspensão de segurança, restrição à concessão de liminares que importem em liberação de recursos públicos), e por corpo institucional dedicado ao exercício dessa fiscalização, a saber: a Advocacia Pública, com fundamento na defesa do erário que se constitui em interesse coletivo, transindividual.

The book begins by discussing a series of general issues involved in the theory of behavior in organizations. It then describes the theory itself in three stages: first, the general structure of the theory; second, definition of the key variables; and third, the interrelationships between the variables. Subsequent chapters show how the theory deals specifically with such issues as roles, decision making, and motivation. The theory presented is a cognitive theory of behavior. It assumes that man is rational (or at least nonrandom) for the most part, and that as a systematic or nonrandom generator of behavior, man's actions are explained best in terms of conscious, thinking acts on the part of the individual. The theory deals with why the individual chooses certain alternative courses of action in preference to others, and thus it might properly be called a theory of choice behavior. Whereas the emphasis is on the cognitive aspects of behavior, considerable attention has been devoted to external, noncognitive variables in the system that play meaningful roles in the determination of individual behavior.
