Book excerpt: A profusão de ações tendentes a impugnar as normas emanadas das agências reguladoras causa inquietações relacionadas aos limites do controle judicial e às possíveis consequências advindas do comportamento ativista que tem caracterizado o Poder Judiciário na última década. A preocupação é ainda mais justificável em matéria de vigilância sanitária, já que a proteção da saúde da população não se concretiza por meio de ações isoladas, mas sim por políticas uniformes. Por certo, a ausência de critérios objetivos para o controle judicial das normas da Agência Nacional de Vigilância Sanitária – Anvisa – pode acarretar a total ineficácia de seus objetivos institucionais. Embora o art. 5o, XXXV da Constituição Federal de 1988, estipule expressamente a inafastabilidade da jurisdição quanto a qualquer lesão ou ameaça a direito, há quem defenda a necessidade de se construir no Judiciário um novo paradigma de atuação no que concerne ao escrutínio das políticas públicas do Executivo, sob pena de desrespeito à separação de poderes. A ideia de autocontenção ou autolimitação judicial (judicial self restraint) ganhou força com o surgimento do chamado princípio ou doutrina da deferência, que encontra correspondência em vários julgados da Suprema Corte estadunidense. Nessa perspectiva, o presente livro tem o objetivo de examinar, primeiramente, se as noções de deferência e autocontenção judicial são compatíveis com o ordenamento jurídico pátrio. Em seguida, por meio da metodologia de estudo de casos, verificar-se-á como o Poder Judiciário brasileiro tem decidido as lides envolvendo a impugnação de normas sanitárias editadas pela Anvisa. Busca-se, dessa forma, responder ao seguinte problema: se, e em quais circunstâncias, o Poder Judiciário brasileiro tem se valido do princípio da deferência ao efetuar o controle judicial dos atos normativos da Anvisa.

In light of recent uprisings around the world against the neoliberal capitalist order, Saul Newman argues that anarchism - or as he calls it postanarchism - forms our contemporary political horizon. In this book, Newman develops an original political theory of postanarchism; a form of anti-authoritarian politics which starts, rather than finishes, with anarchy. He does this by asking four central questions: who are we as subjects; how do we resist; what is our relationship to violence; and, why do we obey? By drawing on a range of heterodox thinkers including La Boétie, Sorel, Benjamin, Stirner and Foucault, the author not only investigates the current conditions for radical political thought and action, but proposes a new form of politics based on what he calls ontological anarchy and the desire for autonomous life. Rather than seeking revolutionary emancipation or political hegemony, we should affirm instead the non-existence of power and the ever-present possibilities of freedom.
