Una volta guadagnato uno sguardo d’insieme, si può cominciare – prudentemente – a dedicarsi alla giurisprudenza (questo è quanto mi hanno insegnato, e che penso sia la chiave che fa la differenza). In altre parole, la giurisprudenza deve essere prima contestualizzata, e poi eventualmente valutata – o criticata: fase che lasciamo a chi può permettersi di farlo. Non è saggio risolvere problemi partendo dai dettagli. Questo commentario non è un prontuario di giurisprudenza – ormai per questa esigenza ci sono le banche dati – né ha l’ambizione di essere un manuale puro. Il proposito è stato quello di renderlo uno strumento che consenta di avere lo sguardo d’insieme di cui dicevo prima, contestualizzando la giurisprudenza e anche la dottrina, così aiutando – si spera – la faticosa attività giornaliera del giurista.
