Esta tendencia ha resultado especialmente provechosa en el ámbito de la normativización de la tipicidad gracias a la teoría de la imputación objetiva, con independencia de que quizás no sea “objetiva” la expresión más afortunada. Esta normativización de la tipicidad ya no se limita exclusivamente a la imputación de resultados a conductas, sino que se extiende a todos los ámbitos de la tipicidad. Lejos quedan los tiempos en los que era objeto de reflexión doctrinal generalizada si la denominada teoría de la imputación objetiva también era válida para los delitos de peligro o para los delitos de mera actividad. Si se parte de la idea de que se trata de imputar injustos penales a personas concretas, los criterios normativos relevantes abarcan cualquier modalidad de injusto penal. Confío en que este análisis de problemas generales de la teoría jurídica del delito con base en los delitos económicos como paradigma de lo que se ha denominado “moderno Derecho Penal” sirva para abrir nuevas perspectivas tanto de las instituciones de la parte general del Derecho Penal como de un grupo de figuras delictivas que cada vez es más evidente que no se dejan abarcar con planteamientos que provienen de la teorización de otros tipos delictivos más clásicos (por ejemplo, la estafa)". New reforms must stem from a widespread and participatory debate, one of a common vision conceived for and by Peruvians. This book aims at making a technical and independent contribution to such debate; it summarizes the knowledge available about the challenges to be faced by the new administration. The study does not recommend silver bullets, but suggests policy options. It is based on the analysis of the current reality and in six decades of relationships with Peru, in which the Bank has implemented more than 100 projects and prepared more than 500 technical reports covering the wide range of development topics. When necessary, the study provides lessons that the Bank has learned elsewhere. The study provides a conceptual framework to the analysis of the country's 34 economic sectors and the two historical perspectives behind them.
