Much work is needed to recduce nuclear dangers between India and Pakistan. While the fact that both countries possess nuclear weapons may prevent a full-blown conventional or nuclear war, the presence of these weapons in the region may also encourage the use of violence at lower levels expecting escalation to be contained by a mutual desire to avoid the nuclear threshold. One only needs to look at the Kashmir conflict for confirmation of this paradox, with serious crises coming more frequently with more severity since the nuclear tests of 1998. Sustained efforts along the line suggested by the contributors of this volume are a crucial step toward reducing nuclear risk on the Subcontinent.

This book seeks to address this question and assesses the region’s nuclear security from two principal standpoints. First, it evaluates the robustness of the Indo-Pakistani mutual deterrence by analysing the strength and weaknesses of the competing arguments regarding the issue. It also analyses the causes and consequences of nuclear arms race between India and Pakistan, the nature of deterrence structure in the region and the challenges of confidence building and arms control between the two countries in order to assess the robustness of South Asia’s nuclear deterrence. Second, it assesses the safety and security of the nuclear assets and nuclear infrastructure of India and Pakistan. The author holds that the debate on South Asia’s nuclear security is largely misplaced because the optimists tend to overemphasise the stabilising effects of nuclear weapons and the pessimists are too alarmists. It is argued that while the risks of nuclear weapons are significant, it is unlikely that India and Pakistan will give up their nuclear arsenals in the foreseeable future. Therefore, what needs to happen is that while nuclear elimination should be the long-term goal, in the interim years the two countries need to pursue minimum deterrence policies to reduce the likelihood of deterrence failure and the possibility of obtaining fissile materials by non-state actors.

Book excerpt: This book advocates pursuing a regional approach to nuclear risk framework, which it argues is more promising in the current scenario than the non-achievable global regime. In the development of international legislation on liability, the nuclear energy sector represents an alternative approach to a transboundary liability regime. Building on this foundation and following the Chernobyl accident, international consensus was sought for a stronger transboundary legal regime in the event of a nuclear disaster. However, after sixty years of the existence of international nuclear liability laws and twenty-five years after Chernobyl, the primary objectives of the Conventions - harmonization and a global regime - remain unfulfilled. Further, many countries are now creating or expanding nuclear programs without adequate transboundary legal protection. In light of these issues, a regional approach is an option that cannot be ignored. Given its rapidly expanding nuclear energy footprint, South Asia is in a unique position to adopt a regional mechanism. The methodology adopted for the study in the book combines a literature review of international law on nuclear liability with an analysis of South Asian nuclear energy programs and their international and national legal obligations. A technical risk assessment study conducted to identify the level of transboundary nuclear risk within South Asia is also presented. This is followed by interviews with experts and policymakers to gauge the willingness of the South Asian Association for Regional Cooperation (SAARC) community to respond to this shared regional concern.

While limited nuclear capabilities increase the costs of conflict, they do little to reduce the risk of its occurrence. Maintaining Nuclear Stability asserts that the development of command and control mechanisms would enhance stability in a crisis and improve India's and Pakistan's ability to avoid nuclear use if war breaks out, and that diplomatic steps particularly focused on missiles must also be considered. With nuclear weapons in hand, the price of potential failed deterrence is catastrophically high. Investing more resources on a bet that nuclear capabilities ensure safety only raises the penalties if the initial decision was wrong. Joeck proposes that command and control and diplomatic engagement provide some insurance that, if that bet is called, nuclear use is not the only choice left.
