In conjunction with the Department of Defense (DoD), to protect the public health and safety by providing dual-Agency judgment and responsibility for the safety, security, and control (surety) of nuclear weapons. To establish nuclear explosive surety standards, nuclear weapon design surety requirements, and NEWS assessment requirements. To address surety vulnerabilities during all phases of the nuclear weapon life cycle and to upgrade surety during weapon stockpile refurbishments and/or new weapon development. To establish requirements and responsibilities for planned nuclear explosive operations (NEOs). [Responses to unplanned events (e.g., Accident Response Group activities) are addressed in the 5530-series Orders and DOE O 151.1B, Comprehensive Emergency Management System, dated 11-01-00.]

The current stockpile, designed to meet the security challenges of the Cold War (highly optimized systems that employ exotic materials with high yields), is not optimized to meet post-Cold War national security challenges. Today's challenge is to sustain and modernize the United States nuclear weapons infrastructure with minimal risk and cost. The following factors must be considered: 1. Technological advances brought about by the Stockpile Stewardship Program make it possible to design weapons that will be less expensive to build, can be certified without full-yield nuclear testing, employ modern surety technologies, and will be less costly to maintain over the long term. 2. Building replacement/new weapons will exercise and force the nuclear weapons production infrastructure to modernize to an extent not possible with the current life-extension program approach. 3. Scientists and engineers with experience in designing and building nuclear weapons are nearing retirement, and it is critical that the United States capture their experience and pass it to the next generation of weapons designers. 4. The "need" for nuclear weapons will increasingly be challenged and debated by the public and the Congress. With the Cold War over and questions arising regarding the utility of nuclear weapons to deter rogue states and nonstate actors, a clear vision on the need for nuclear weapons is required. 5. The federal budget is highly constrained for the foreseeable future and will likely result in fiat (inflation-only increases) or decreases to the nuclear budget.

Yet they deteriorate and must be maintained. To correct problems, a Life Extension Program (LEP), part of a larger Stockpile Stewardship Program (SSP), replaces components. Modifying some components would require a nuclear test, but the United States has observed a test moratorium since 1992. Congress and the Administration prefer to avoid a return to testing, so LEP rebuilds these components as closely as possible to original specifications. With this approach, the Secretaries of Defense and Energy have certified stockpile safety and reliability for the past 12 years without nuclear testing. NNSA argues it will become harder to certify current warheads with LEP because small changes may undermine confidence in warheads, perhaps leading to nuclear testing, whereas new-design replacement warheads created by the RRW program will be easier to certify without testing. Critics believe LEP and SSP can maintain the stockpile indefinitely. They worry that untested RRWs may make testing more likely and question cost savings, given high investment cost. They note that there are no military requirements for new weapons. Others feel that neither LEP nor RRW can provide high confidence over the long term, and would resume testing. Another point of view is that either LEP or RRW will work without nuclear testing. This report provides background and tracks legislation. It will be updated to reflect final FY2010 congressional action on RRW.
