Book excerpt: Excerpt from Notices of Judgment Under the Insecticide Act (Given Pursuant to Section 4 of the Insecticide Act), 1636-1655 On April 30, 1935, the United States attorney for the Western District of Washington, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 117 cans of Nourse Gall Remedy at Seattle, Wash.; alleging that the article had been shipped in interstate commerce on or about November 23, 1934, from Kansas City, Mo., by Nourse Oil Co.; and charging misbranding in violation of the Insecticide Act of 1910. The article was alleged to be misbranded in that the statement appearing on a leaflet shipped with it, Mange t Mange on Live Stock, Dogs and Household Pets are greatly benefited by its use, was false and misleading and tended to deceive and mislead the purchaser since the product was not an effective treatment for all varieties of mange which infest livestock, dogs, and household pets. The article also was alleged to be misbranded in violation of the Food and Drugs Act as reported in notice of judgment No. 29019 published under that act. On April 4, 1938, no answer to the libel having been filed, judgment of condemnation was entered and the product was ordered destroyed. Book excerpt: Excerpt from Notices of Judgment Under the Insecticide Act (Given Pursuant to Section 4 of the Insecticide Act) 1551-1575 This product was represented to be derris, which contained a minimum of 5 percent of rotenone, but which in fact consisted of cube root containing less than 5 percent of rotenone. On March 24, 1937, the United States attorney for the Southern District of New York, acting upon a report by the Secretary of Agriculture, filed in the district court an information against R. J. Prentiss Co., Inc., New York, N. Y., alleging shipment by said company on or about July 23, 1935, from the State of New York into the State of Delaware of a quantity of derris, which was an adulterated and misbranded insecticide other than paris green and lead arsenate within the meaning of the Insecticide Act of 1910. The article was alleged to be adulterated in that the statement Derris borne on the barrels containing it represented that the said barrels contained derris; whereas they did not contain derris but another substance, cube root, had been substituted for derris. Adulteration was alleged for the further reason that the strength and purity of the article fell below the professed standard and quality under which it was sold, since it was represented to contain a minimum of 5 percent of rotenone; whereas it contained rotenone in a proportion much less than 5 percent. It was alleged to be misbranded in that the statements Derris Min. Rotenone, borne on the barrels containing it, were false and misleading and by reason of the said statements the article was labeled and branded so asto deceive and mislead purchasers since the barrels did not contain derris but did contain another substance, namely, cube root; and the article did not contain 5 percent of rotenone but did contain much less than 5 percent of rotenone. On May 10, 1937, a plea of guilty was entered on behalf of the defendant and the court imposed a fine of $100. On September 17, 1932, the United States attorney for the District of Oregon, acting upon a report by the Secretary of Agriculture, filed in the district court an information against the Acme White Lead Color Works, a corpora tion trading at Portland, Oreg, alleging shipment by said company, in viola tion of the Insecticide Act of 1910, on or about January 5, 1932, from the State of Oregon into the State of Washington, of a quantity of Acme 2 Way spray that was adulterated and misbranded. It was alleged in the information that the article was adulterated in that it was intended for use on vegetation, namely, sour cherry trees, and the article when used as a spray upon sour cherry trees as directed, would be injurious to such vegetation. Misbranding was alleged for the reason that the statements on the label, For sour cherries, use 7 pounds of Acme 2 Way Spray to, 50 gallons of water or 10 tablespoonfuls to 1 gallon of water borne on. The package label, were false and misleading and by reason of the statements the article was labeled so as to deceive and mislead the purchaser, since the article, when used as directed, could not be used as a spray for all sour cherry trees, but such use would cause serious injury thereto. On January 11, 1933, a plea of guilty to the information was entered om behalf of the defendant company, and the court imposed a fine of $10. Wash clothing, vessels, linen, floors, and woodwork, borne on the bottle label, were false and misleading and by reason of the said statements the article was labeled so as to deceive and mislead the purchaser in that they represented that the article would disinfect waste pipes, could be relied upon to disinfect the cellar when used as directed, and would be an effective disinfectant for garbage cans, kitchen sinks and tubs, for the sickroom, on clothing, vessels, linens, floors. And woodwork, when used at the dilutions recommended; whereas it would not be effective for the said purposes when used as directed at the dilutions recommended. The article was alleged to be misbranded further in that it consisted partially of an inert substance, namely, water, which substance does not prevent, destroy, repel, or mitigate insects or fungi (bacteria) and the name and percentage amount of the said inert substance were not stated plainly and correctly on the label affixed to the bottle containing the article; nor in lieu thereof were the name and percentage amount of each substance or ingredient of the article having fungicidal (bactericidal) properties, and the total percentage of the inert substance present therein stated plainly and correctly on the bottle label. Book excerpt: Excerpt from Notices of Insecticide Act Judgment: No. 31-No. 61 On February 28, 1913, the United States Attorney for the Southern District of New York, acting upon the report of the Secretary of Agriculture, filed information in the District Court of the United States for said district against Benjamin Hammond, Fishkill-on Hudson, N. Y., doing business under the name and style of Ham mond's Paint Slug Shot Works, alleging the shipment and delivery for shipment, on June 1, 1911, from fishkill-on-hudson, in the State of New York, to Milwaukee, in the State of Wisconsin, of a quantity of a' certain insecticide, designated Kerosene Oil Emulsion, which was misbranded within the meaning of the Insecticide Act of 1910. The article was labeled or branded: Hammond's Paint Slug Shot Works. One Gallon. Established in 1875. Kerosene Oil Emulsion. Ready for Immediate Use by Dilution. An Insecticide of great value and extensively recommended for use on Scale Insects, aphis, caterpillars, Bugs and Worms of all kinds. This Coneen trated Emulsion is to be diluted with 25 to 40 parts of soft water. Shake well and if it does not pour readily add a little water. After dilution apply it with a spray pump. Book excerpt: Excerpt from Notices of Judgment Under the Insecticide Act: Given Pursuant to Section 4 of the Insecticide Act, 1711-1730 On September 9, 1939, the United States attorney for the District of Oregon, acting upon a report by the Secretary of Agriculture, filed in the district court an information against the American Brush Co., a corporation, Portland, Oreg., alleging shipment by it in violation of the Insecticide Act of 1910 on or about January 13, 1939, from Portland, Oreg., into the State of Washington of a quantity of Abco Pine Disinfectant, which was a misbranded fungicide. The article was alleged to be misbranded in that it consisted partially of an inert substance, namely, water, and the name and percentage amount thereof were not stated upon the label; nor in lieu thereof were the name and percentage amount of each substance therein possessing fungicidal properties, and the total percentage of the inert substance stated plainly and correctly on the label. It was alleged to be misbranded further in that the statements, non-toxic Disinfectant Use 1 to 2 ounces to each gallon of water for all general disinfecting purposes, borne on the label, were false and misleading, and by reason thereof it was labeled so as to deceive and mislead purchasers, since it was not nontoxic and it was not an effective disinfectant when used in the dilution specified. Y., into the State of New Jersey, of quantities of Tote, and charging that the product was a misbranded insecticide within the meaning of the Insecticide Act of 1910. The product was alleged to be misbranded in that the labels affixed to the cans in the shipment of June 28, 1944, stated in part: (1) Tote Double Strength Kills Flies Roaches Guaranteed to kill insects it is a killer of household insects For Flies All windows and doors should be closed, begin at farthest end of the room away from the door, Spray towards the ceiling and cover every part of the room, keep door closed for a few minutes, this will kill mosquitoes and flies and the odor will keep others from entering For Roaches Spray freely into all cracks and crevices of base board, behind sink wash tub and ice box, several times a week, (2) Contents One Quart, and (8) Contains Pyrethrum Extract, which state ments were false and misleading as the product when used as directed would not kill flies, roaches, and all household insects, its odor would not keep out mosquitoes and flies, the package did not contain 1 quart, and the product did not contain pyrethrum extract. The transformations along these three dimensions density, distance, and division are most noticeable in North America, Western Europe, and Japan, but countries in Asia and Eastern Europe are changing in ways similar in scope and speed. 'World Development Report 2009: Reshaping Economic Geography' concludes that these spatial transformations are essential, and should be encouraged. The conclusion is not without controversy.
